PURPOSE/ACTION REQUESTED
Authorize the Enterprise Finance and Information Services Director to execute a Fiber Optic Indefeasible Right to Use Agreement (IRU) with the City of South St. Paul for a joint fiber optics project.

SUMMARY
The City of South St. Paul managed the Concord Avenue street project and used a "dig once" opportunity to maximize the opportunity to make infrastructure improvements. Dakota County partnered with South St. Paul on this street project by providing fiber materials for future traffic signal connectivity needs. South St. Paul agreed to lead the project and provide 288 strands of fiber for future fiber needs.
* Out of the 288 fiber strands that South St. Paul originally provided, Dakota County desires to own 144 fibers to connect, as described in this Agreement; and

* South St. Paul agrees to grant to Dakota County the right to own 144 fibers and two conduits with vaults within certain fiber optical cable segments.
