PURPOSE/ACTION REQUESTED
Authorize the Sheriff's Office to execute a joint powers agreement (JPA) with Minnesota Bureau of Criminal Apprehension (BCA) Anti-Heroin Task Force Program (Task Force).

SUMMARY
The State of Minnesota, through the Department of Public Safety, Bureau of Criminal Apprehension, is offering to continue the joint powers agreement with the Dakota County Sheriff's Office for participation in the Minnesota Anti-Heroin Task Force Program. Due to the rise in opioid drug deaths, this program was essentially formed to target the distribution of heroin in the State of Minnesota. Through the Task Force, officers investigate traffickers linked to fatal opioid-related overdose deaths, investigate practitioners prescribing opioids in violation of state and federal law, and investigate street level dealers to obtain cooperation in obtaining information leading to the source of heroin supplies.

When applicable, the Sheriff's Office is eligible to request reimbursement from the State of Minnesota for overtime expenses incurred for licensed detectives while they are engaged in the investigation of these heroin-related offenses under the direction of the State's Bureau of Criminal Apprehension. The Dakota County Drug Task Force has its own JPA with the BCA Anti-Heroin Task Force Program.

Under the previous JPA, Resolution No. 19-895 which expires on March 18, 2025 and covered a five-year period, the Sheriff's Office did not submit for overtime reimbursement. The JPA will be effective on the date the State obtains all required signatures and will expire five years from that date unless terminated earlier under the provisions set forth in the agreement.
