RESOLUTION
body
WHEREAS, in accordance with Minn. Stat. § 375A.04, the Dakota County Board of Commissioners acts as the Community Health Board and has the responsibility to prevent disease and disability and to promote and protect the health and safety of county citizens in accordance with Minn. Stat. ch. 145A; and
WHEREAS, in early February 2024, Dakota County signed onto the Steve Rummler Hope Network’s (SRHN)’s standing order for naloxone, allowing the county to become a Naloxone Access Point (NAP) with SRHN; and
WHEREAS, a NAP is a publicly accessible pick-up site for naloxone, the lifesaving opioid overdose antidote; and
WHEREAS, as a registered NAP, the SRHN will provide Dakota County with naloxone kits and fentanyl test strip kits, which are tools that can help reduce opioid overdose deaths in our communities; and
WHEREAS, these kits include quick response (QR) codes that link to training and support resources, along with their free online naloxone training course, which covers topics such as how to recognize an opioid overdose, how to administer naloxone, and how to safely store the kit; and
WHEREAS, access to intramuscular naloxone is offered to the County at no cost, but due to the high cost of nasal naloxone, additional funds are needed to support access to nasal naloxone, which is important for public use as it is an intuitive device to use for non-medical personnel; and
WHEREAS, nasal naloxone has also been mandated for multiple other groups, including law enforcement and schools; and
WHEREAS, Narcan is a brand of nasal naloxone that was approved by the Food and Drug Administration (FDA) for over-the-counter use last year; and
WHEREAS, in accordance with the Amended Minnesota Opioids State-Subdivision Memorandum of Agreement, the authorization is for expenditures of opioid settlement funds up to $15,000 over the period of March 1, 2024 through December 31, 2026; and
WHEREAS, in planning for the budgeting of opioid settlement funds in 2024, an allocation of unassigned funds was determined in the amount of $135,998, of which the proposed $15,000 would be allotted from these funds to the Public Health Budget; and
WHEREAS, the expenditure aligns with the Memorandum of Agreement’s list of opioid remediation uses in exhibit A, section H, subsection 1, which states the remediation use of increasing the availability and distribution of naloxone and other drugs that treat overdoses for first responders, overdose patients, individuals with Opioid Use Disorder (OUD) and their friends and family members, schools, community navigators and outreach workers, persons being released from jail or prison, or other members of the general public.
NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners authorizes the allocation of $15,000 of opioid settlement funds to the 2024 Public Health budget for the purchase of nasal naloxone for community distribution for the period of March 1, 2024 through December 31, 2026; and
BE IT FURTHER RESOLVED, That the Dakota County Board of Commissioners authorizes the Community Services Director to execute a contract, if necessary, for the purchase of nasal naloxone, with Steve Rummler Hope Network in an amount up to $15,000 for the period of March 1, 2024 through December 31, 2026; and
BE IT FURTHER RESOLVED, That the Community Services Director is hereby authorized to amend said contract, consistent with the amount budgeted, to alter the contract amount and the contract term up to one year after initial expiration date, consistent with County contracting policies, subject to approval by the County Attorney’s Office as to form; and
BE IT FURTHER RESOLVED, That the contract shall contain a provision that allows the County to immediately terminate the contract in the event sufficient funds from county, state, or federal sources are not appropriated at a level sufficient to allow payment of the amounts due; and
