WHEREAS, County Project (CP) 42-163 is the engineering and reconstruction of County State Aid Highway (CSAH) 42 from Redwood Drive to Pennock Avenue in the city of Apple Valley; and
WHEREAS, this segment of CSAH 42 serves residential, park, and local business uses, but it has poor pavement quality and long-outdated elements for pedestrians, bicyclists, and transit riders; and
WHEREAS, the redesign and reconstruction of this segment of CSAH 42 will comprehensively improve safety for all travelers, fill trail gaps, and improve infrastructure for all stakeholders; and
WHEREAS, the scope of construction will also include the replacement of underground public utilities, including the City’s water supply and sanitary sewer lines and the service connections for all properties adjacent to the project; and
WHEREAS, the combined CSAH 42 and city infrastructure elements will require the acquisition of right of way; and
WHEREAS, Dakota County is the lead agency for CP 42-163, with right of way acquisition necessary in 2026 for construction to begin in the spring of 2027; and
WHEREAS, the County has been utilizing public engagement for this project, which has included four open-house meetings, most recently hosted on April 16, 2026; and
WHEREAS, the acquisition of 93 private property parcels identified in Dakota County Right of Way Map No. 514 by the County is necessary to move forward with CP 42-163:

WHEREAS, the parcels have been appraised, and offers were prepared and sent for a total certified appraised value of $1,308,700; and
WHEREAS, in the event that timely acquisition by direct negotiation of all required parcels does not appear possible, it may become necessary for the County Board to authorize the County Attorney’s Office to initiate quick-take condemnation of the remaining parcels to allow for a spring 2027 start date; and
WHEREAS, parcels that have settled through negotiation prior to the date required for filing the condemnation petition will not be included.
NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby authorizes the County Attorney’s Office to initiate quick-take condemnation of the remaining parcels to allow a spring 2027 start date in the event that timely acquisitions by direct negotiations of all parcels do not appear possible.

BACKGROUND
To provide a safe and efficient transportation system, Dakota County is proceeding with the design of CP 42-163, the reconstruction of County State Aid Highway (CSAH) 42 along a one-mile segment in the city of Apple Valley from Redwood Drive to Pennock Avenue (Attachment: Project Location Map). In 2022, Dakota County applied for and received a federal grant of $6,540,000 to support construction of the project. Construction is scheduled to begin in 2027.
The project area includes frontage roads serving more than 80 residential parcels on both sides of CSAH 42. The segment also includes a number of business properties around the CSAH 42 intersection with Garden View Drive.
The County Board previously approved the right of way acquisition for projects included in the 2025 Transportation Capital Improvement Program, including CP 42-163, by Resolution No. 25-052 (January 21, 2025). This board action included authorization to make first offers based on appraised values and delegated settlement authority to the County Manager.
Patchin Messner Valuation Counselors and Valbridge Property Advisers have completed appraisals with a total appraised value of $1,308,700. Offers were sent to property owners on May 12, 2026. County staff is currently in ongoing direct negotiations with property owners to reach a settlement.
If timely acquisition by direct negotiation of all required parcels does not appear possible, staff recommends that the County Board authorize the County Attorney’s Office to initiate quick-take condemnation of the remaining parcels. Efforts will be made to negotiate agreeable settlements before and after the start of the condemnation process.

FINANCIAL AND STAFFING IMPACTS
The Transportation Capital Improvement Program includes $25,230,791 for Project 1001535 Reconstruction. There is sufficient project budget available to fund the proposed right-of-way acquisitions, with all currently appraised for a total value of $1,308,700.
