PURPOSE/ACTION REQUESTED

Authorize contract execution with the Minnesota Department of Transportation (MnDOT) for Architectural And Archeological History Survey for County State Aid Highway (CSAH) 26 Roadway Reconstruction in City of Eagan, County Project (CP) 26-67 (Attachment: Project Location Map).

 

SUMMARY

To provide a safe and efficient transportation system Dakota County is proceeding with CP 26-67 in the city of Eagan. County Project 26-67 that will improve County State Aid Highway (CSAH) 26 (Lone Oak Road) roadway by modifying the existing roadway from a four lane and five lane undivided roadway section to a lane reduction with one through lane in each direction from CSAH 31 (Pilot Knob Road) to I-35E. The project includes reconstruction of roadway and trail along CSAH 26 from Trunk Highway (TH) 13 to CSAH 31 and pedestrian crossings adjacent to Pilot Knob Stem School in conformance with the School Travel Area Safety Assessment. This assessment identified safety improvements for portions of CSAH 26 near Pilot Knob Stem Elementary School. Construction for CP 26-67 is scheduled to occur in 2025.

 

By Resolution No. 22-043 (January 24, 2022), the County Board authorized execution of a contract with Bolton & Menk for design services for CP 26-67. During the design phase, Bolton & Menk embarked upon MnDOT’s Environmental Early Notification Memo (ENM) process, which is used to provide early notification of a proposed project and/or request early review of the project to ensure that environmental concerns and other interests related to the project are considered in the project scoping, layout or design. During this process it was determined there is a potential presence of architectural and archeological artifacts in the project limits. This requires cultural resource identification efforts for this project and includes the following:

 

                     Phase I archaeological reconnaissance survey - Archaeological Review Area (ARA) should include proposed permanent and temporary easements (Attachment: Archaeological Review Area) within the project limits, and proposed construction limits including, equipment staging/laydown areas. 

 

Note: If sites are identified and for which a National Register of Historic Places (NRHP) recommendation is not possible at the Phase I level, then additional (Phase II) evaluation will be needed.

                     Phase I architecture-history investigation of intersected parcel structures - Architecture-History Review Area would include:

o                     A 150-foot buffer around the center line. Properties to be surveyed within the Area of Potential Effects (APE) are those built by 1979. Properties where the APE is only affecting a heavily wooded area of the parcel (i.e., houses on McCarthy Road) likely will not require inventory as the work will likely not be visible from the properties. Approximately 31 Phase I inventory forms would be needed.

o                     Pilot Knob School: Tax information gives the construction date as 1990, but it looks like it was actually built around 1969-1971, so this will require survey. Aerial photographs don’t show extensive construction or additions.

 

Dakota County will need to enter an agreement with MnDOT’s Cultural Resource Unit (CRU) to complete this necessary work. MnDOT’s CRU sent requests for bids to pre-qualified firms and determined Bolton & Menk, Inc. (BMI) provided the most comprehensive proposal and has been selected as the contractor for this project (MnDOT Contract No. 1055047). The estimate fee is $82,511.65. MnDOT would be responsible for 80 percent of the cost of this contract, at $66,009.32 and Dakota County would be responsible for 20 percent of the cost, at $16,502.33.

EXPLANATION OF FISCAL/FTE IMPACTS

The Adopted 2024 Transportation Capital Improvement Program (CIP) Budget includes a total of $8,690,000 which includes $4,740,000 of Federal funding for CP 26-67. The total estimate fee for cultural resource investigations contract with MnDOT is $82,511.65. MnDOT would be responsible for 80 percent of the cost of this contract, at $66,009.32, and Dakota County would be responsible for 20 percent of the cost of this contract, at $16,502.33.

 

There is sufficient funding for the Architectural and Archeological History survey work costs for CP 26-67 (Attachment: Financial Summary).

WHEREAS, to provide a safe and efficient transportation system, Dakota County (County) is proceeding with County Project (CP) 26-67, the reconstruction of County State Aid Highway (CSAH) 26 from Trunk Highway (TH) 13 to CSAH 31 and a lane reduction of CSAH 26 from CSAH 31 to I-35E in the City of Eagan; and

WHEREAS, CP 26-67 includes a trail as part of the School Area Safety Assessment recommendations for Pilot Knob STEM School from TH 13 to CSAH 31; and

 

WHEREAS, the County is the lead agency for the Project; and

 

WHEREAS, Bolton & Menk, in coordination with the Minnesota Department of Transportation’s (MnDOT) Cultural Resource Unit (CRU), determined a potential presence of architectural and archeological artifacts in the project limits that would trigger a requirement for cultural resource identification efforts; and

 

WHEREAS, in order to fulfill the requirements deemed necessary by the Cultural Resources Unit (CRU), MnDOT needs a contractor to complete the Architecture and Archeological History survey for the CSAH 26 Improvements Project located in the City of Eagan, Dakota County, MN; and

 

WHEREAS, to meet this requirement, County staff elected to proceed with the contracting process to establish an agreement with MnDOT’s CRU to complete this necessary Architecture and Archeological History survey work; and

 

WHEREAS, under this agreement, MnDOT CRU will select the contractor, manage the contract, and cover 80 percent of the cost, and the County will be responsible for the remaining 20 percent; and

 

WHEREAS, Following the Federal contracting process, MnDOT CRU sent requests for bids for the necessary cultural resource investigations to pre-qualified firms and ultimately independently determined that Bolton & Menk, Inc. (BMI) provided the most comprehensive proposal and has been selected as the contractor by MnDOT for this project under MnDOT Contract No. 1055047 for a total fee of $82,511.65; and

 

WHEREAS, based on the cost share responsibilities from MnDOT’s CRU contract, MnDOT will be responsible for $66,009.32 (80% of the contract cost), and the County will be responsible for $16,502.33 (20% of the contract cost); and

 

WHEREAS, by entering into this contract, Bolton & Menk, Inc. (BMI) will then be responsible for completing the necessary tasks under the contract scope of work with the supervision and review of MnDOT’s CRU.

 

NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby authorizes executing a contract with Minnesota Department of Transportation (MnDOT) for an Architectural and Archeological History Survey for County State Aid Highway 26 Roadway Reconstruction of Lone Oak Road In City Of Eagan for County Project 26-67 for MnDOT Contract Number 1055047.
