PURPOSE/ACTION REQUESTED

Authorize the Enterprise Finance and Information Services Director to amend the fiber optic Indefeasible Right to Use Agreement with City of South St. Paul.

 

SUMMARY

By Resolution No. 24-407 (August 13, 2024), the Board of Commissioners approved authorizing the Enterprise Finance and Information Services Director to execute an Indefeasible Right to Use (IRU) Agreement with the City of South St. Paul.

 

The IRU facilitates a jointly built network for efficient and secure public cyber traffic, under which the City of South St. Paul is granting Dakota County the right to own 144 strands in the City’s fiber optic cable. The amended agreement clarifies that the fiber optic cable will be installed in conduit owned by Dakota County.

 

Staff is requesting that the prior authorization for the IRU Agreement be amended to include authorization for the City of South St. Paul to install and maintain fiber optic cable within Dakota County’s conduit.

EXPLANATION OF FISCAL/FTE IMPACTS

The City of South St. Paul will split the overall costs with Dakota County using existing Dakota County owned conduit and vaults. The total cost for each entity is $42,100.90.

WHEREAS, on August 13, 2024, the Dakota County Board of Commissioners adopted Resolution No. 24-407, authorizing the Enterprise Finance and Information Services Director to execute an Indefeasible Right to Use Agreement with the City of South St. Paul for use of the jointly built institutional network; and

 

WHEREAS, as part of the project approved by Resolution No. 24-407, The City of South St Paul granted Dakota County the right to own 144 strands in the City’s fiber optic cable; and

 

WHEREAS, this amended authorization is intended to clarify that the Indefeasible Right to Use Agreement shall include authorization for the City of South St. Paul to install and maintain fiber optic cable within the County’s conduit.

 

NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby authorizes the Enterprise Finance and Information Services Director to execute an amended  Indefeasible Right to Use Agreement with the City of South St. Paul for use of the jointly built institutional network through which the City of South St. Paul will grant Dakota County the right to own 144 fibers and Dakota County will grant the City of South St. Paul the right to install and maintain fiber optic cable segments within conduit owned by the County, subject to approval by the County Attorney’s Office as to form.
