PURPOSE/ACTION REQUESTED
Authorize an encroachment agreement with Ryan Companies US, Inc (owner) for the encroachment of a proposed stoop and sidewalk along County State Aid Highway 28 over an existing County trail, drainage, and utility easement per document no. 3460583.
SUMMARY
A proposed redevelopment project includes adding a new emergency door entrance on the north end of the existing building of the Ryan Companies US, Inc., (owner) and ACME Tools (proposed tenants) parcel (Attachment: Parcel Map for Encroachment Agreement). This proposed door entrance, required by the City of Eagan, will include a stoop and sidewalk, and will encroach over the existing County trail, drainage, and utility easement per document no.3460583 (Attachment: Encroachment Agreement and Easement). The legal description of the parcel affected is Lot 1, Block 1, TOWN CENTRE 100 TWENTY FIRST ADDITION.
The County Attorney’s Office reviewed the encroachment agreement to be recorded subject to a City of Eagan construction building permit for ACME Tools, to be released on August 20, 2024.

WHEREAS, the County has an existing trail, drainage, and utility easement along County State Aid Highway (CSAH) 28 per document no. 3460583; and
WHEREAS, Ryan Companies US, Inc., is the owner and ACME Tools are the proposed tenants of Lot 1, Block 1, TOWN CENTRE 100 TWENTY FIRST ADDITION; and
WHEREAS, the City of Eagan includes a proposed redevelopment of an existing building for ACME Tools (proposed tenants), which requires an emergency access door with a stoop and sidewalk on the north end of the building along CSAH 28; and
WHEREAS, to construct the proposed stoop and sidewalk, an encroachment agreement is required over the County’s existing trail, drainage, and utility easement; and
WHEREAS, Transportation has determined the proposed encroachments will not interfere with the public’s easement interest; and
WHEREAS, the encroachment agreement was reviewed and approved by the County Attorney’s Office.
NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby authorizes the execution and recording an encroachment agreement with Ryan Companies US, Inc., over the existing trail, drainage, and utility easement per document 3460583, subject to the City of Eagan providing a city construction building permit to ACME Tools.
