WHEREAS, to advance a safe and efficient transportation system, Dakota County is proceeding with County Project (CP) 26-60 in the City of Inver Grove Heights; and
WHEREAS, Dakota County has included CP 26-60 in its Transportation Capital Improvement Program to improve County State Aid Highway 26 (70th Street) in Inver Grove Heights; and
WHEREAS, CP 26-60 is a planned reconstruction of a portion of County State Aid Highway 26 between Trunk Highway 3 and County State Aid Highway 73 in Inver Grove Heights and includes an expansion to three lanes, construction of stormwater sewer, construction of multiuse trail, extension of city utilities and traffic safety and access management improvements; and
WHEREAS, acquisition of the following 19 private property parcels identified in Dakota County Right of Way Map No. 521 is necessary for CP 26-60 to proceed into construction:

NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby authorizes the County Attorney’s Office to initiate quick-take condemnation for remaining parcels necessary for Count Project 26-60 if timely acquisition through direct negotiation does not appear possible.

BACKGROUND
To provide a safe and efficient transportation system, Dakota County and the City of Inver Grove Heights are proceeding with County Project (CP) 26-60 on County State Aid Highway (CSAH) 26. CP 26-60 is a planned reconstruction of 1.0-mile segment of CSAH 26, expanding it from two lanes to three and adding storm sewer, intersection improvements and multiuse trail. This project will address traffic safety, access management, and pedestrian accommodations and include extensions of city utilities. Development and construction of CP 26-60 will be concurrent with CP 26-68 directly east of the CP 26-60 project area (Attachment: Project Map).
Dakota County is serving as the lead agency for right of way acquisition for CP 26-60. Acquisition is required from 19 private parcels (Attachment: Acquisition Map). Appraisals for all parcels have been completed with a total appraised value of $457,200. Offers were issued in August 2026. Negotiations with property owners are ongoing; a fee acquisition of Parcel 3 was completed in April 2026. CP 26-68 does not require acquisition of any right of way for its completion.
Although staff continues to pursue voluntary agreements with all property owners, it is possible that not all parcels will be secured through timely direct negotiation. To avoid delays to the project schedule, staff recommends that the County Board authorize the County Attorney’s Office to initiate quick-take condemnation for any remaining parcels as needed. This authority will allow the County to obtain possession in time to meet construction milestones while continuing good-faith negotiations before and after any filing. Staff will continue working with property owners and the County Attorney’s Office to complete all acquisitions as efficiently and cooperatively as possible.

FINANCIAL AND STAFFING IMPACTS
The 2026 Capital Improvement Program Budget contains sufficient funding for the acquisition of the required right of way to advance CP 26-60.
