WHEREAS, the 2021 Building Capital Improvement Program (CIP) Adopted Budget authorized the Law Enforcement Center (LEC) 3100 and 7100 Cell Block Upgrades project; and
WHEREAS, Century Construction Company, Inc. was awarded the project by Resolution 22-307 (July 19, 2022); and
WHEREAS, after beginning the project but prior to its completion, Century Construction Company, Inc., ceased operations on August 2, 2023; and
WHEREAS, Dakota County initiated a claim against Century Construction’s performance bond with Surety provider on West Bend Mutual Insurance on August 3, 2023; and
WHEREAS, West Bend Mutual Insurance identified and sought bids from alternative contractors to complete the project work; and
WHEREAS, West Bend Mutual Insurance received a bid from AVM Construction LLC to complete the project for $829,400, which it has tendered to the County for consideration as a replacement contractor; and
WHEREAS, staff and LHB Architects reviewed the qualifications of the bidder and recommend awarding the contract to AVM Construction LLC in an amount not to exceed $829,400.00 for completion of the LEC 3100 and 7100 Cell Block Improvements project; and
WHEREAS, funding for the project is within the approved 2021 Building CIP Adopted Budget, and, by separate agreement, West Bend Mutual Insurance will indemnify the County for the amount in excess of the remaining balance on the contract originally awarded to Century Construction.
NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby authorizes the Parks, Facilities, and Fleet Management Director to execute a contract with AVM Construction LLC a Minnesota limited liability company located at 132 Hardman Court, South Saint Paul, MN 55075, in an amount not to exceed $829,400, for the Law Enforcement Center 3100 and 7100 Cell Block Improvements project, subject to approval by the County Attorney’s office as to form; and
BE IT FURTHER RESOLVED, That the Dakota County Board of Commissioners hereby authorizes Parks, Facilities, and Fleet Management Director to execute a Tender and Release Agreement with Surety West Bend Mutual Insurance accepting the Surety’s tender of a replacement contractor for the project and providing for payment to the County of the bid amount in excess of remaining unpaid contract funds in exchange for the cancellation and release of performance and payment bonds held by the County; and
BE IT FURTHER RESOLVED, That the 2023 Buildings Capital Improvement Program budget is hereby amended as follows:
