PURPOSE/ACTION REQUESTED
Authorize the granting and execution of a trail easement and temporary construction easement (Easements) to the City of Hastings (City) for the trail improvement project along Pleasant Drive.
SUMMARY
The County owns a 2.57-acre property (Parcel Identification Number 19-66601-01-100) in the City, currently used as open green space adjacent to the solar panel array in the southern lawn of the Administration Center.
The City is performing a road improvement project along Pleasant Drive that will include both full reconstruction and pavement reclamation. In addition to the roadway work, the City is also planning to install a new 10-foot bituminous multi-use trail along the west side of Pleasant Drive. Currently, there is an existing sidewalk along the County’s property, but it will be upgraded to the multi-use trail as part of the roadway improvement project. The easement needs for the City include both a small strip of permanent trail easement to accommodate the 10-foot bituminous trail and a temporary construction easement to allow for the necessary grading work during construction, as shown on the County Easement Exhibit attachment.
Historically, the County and its city partners have provided one another with necessary easements at no cost when the project served a public purpose. This continued cooperation helps achieve projects in a timely and cost-effective manner for the residents of the County.

WHEREAS, the County of Dakota owns Parcel Identification Number 19-66601-01-100 (Property) in the City of Hastings (City), which is currently used for open space purposes; and
WHEREAS, the City is planning to add a multi-use bituminous trail along Pleasant Drive; and
WHEREAS, the addition of trail along Pleasant Drive requires a temporary construction easement along the Property, encompassing 4,177 square feet, legally described as follows:
A TEMPORARY EASEMENT FOR CONSTRUCTION PURPOSES OVER AND ACROSS THAT PART OF LOT 10, BLOCK 1, SCHUMACHER 2ND ADDITION, ACCORDING TO THE RECORDED PLAT ON FILE AND OF RECORD IN THE OFFICE OF THE COUNTY RECORDER, DAKOTA COUNTY, MINNESOTA, DESCRIBED AS FOLLOWS:
ALL THAT PART OF THE NORTHWESTERLY 20 FEET OF THE SOUTHEASTERLY 26 FEET LYING SOUTHWESTERLY OF THE NORTHEASTERLY 111 FEET THEREOF.

WHEREAS, the addition of trail along Pleasant Drive requires a permanent trail easement along the Property, encompassing 1,414 square feet, legally described as follows:
A PERPETUAL EASEMENT FOR TRAIL PURPOSES OVER AND ACROSS THAT PART OF LOT 10, BLOCK 1, SCHUMACHER 2ND ADDITION, ACCORDING TO THE RECORDED PLAT ON FILE AND OF RECORD IN THE OFFICE OF THE COUNTY RECORDER, DAKOTA COUNTY, MINNESOTA, DESCRIBED AS FOLLOWS:
ALL THAT PART OF THE SOUTHEASTERLY 6 FEET LYING SOUTHWESTERLY OF THE NORTHEASTERLY 75 FEET THEREOF.
NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby grants and authorizes the Board Chair to execute the permanent trail easement and temporary construction easement legally described above to the City of Hastings for the trail improvement project along Pleasant Drive, subject to approval by the County Attorney’s Office as to form.
