WHEREAS, by Resolution No. 03-285 (May 20, 2003), the Dakota County Board of Commissioners adopted the Dakota County East-West Corridor Preservation Study; and
WHEREAS, the adopted preservation corridor Alignment B between Highview Avenue and Trunk Highway 3 follows the proposed transition between the 179th Street alignment and 175th Street alignment; and
WHEREAS, County Project (CP) 97-231 includes design, right of way dedication, and construction of two segments of 179th Street (future County Road 9) totalling approximately one-half mile of a future County road to meet County standards; and
WHEREAS, the first segment of CP 97-231 will be completed with the Pheasant Run of Lakeville Eighth Addition plat from approximately 400-feet east of Embers Avenue to the future 179th Street bridge over the North Creek (approximately 600-feet); and
WHEREAS, the second segment of CP 97-231 will be completed with the Brookshire 3rd Addition improvements from Eagleview Dr to 775-feet east of Draft Horse Blvd, approximately 2100-feet of future county road; and
WHEREAS, the Dakota County 2040 Transportation Plan (July 2021) Cost Share Policy includes Policy F.14 - Future County Road Segments that allows, at County discretion, to participate in the construction and engineering costs in accordance with F.1 for constructing local roadways that are identified as future County highway segments to County standards, over and above the costs that would have been incurred to construct the segment to city collector street standards; and
WHEREAS, designing and constructing 179th Street to County road standards will reduce future
costs to upgrade the road segment at the time of jurisdictional transfer and reduce impacts to the surrounding community; and
WHEREAS, the City of Lakeville is the lead agency for CP 97-231; and
WHEREAS, executing a joint powers agreement (JPA) agreement with the City of Lakeville is necessary to define project cost shares, roles, and responsibilities for the design, right of way dedication, construction, and maintenance for CP 97-231, all in accordance with County policy; and
WHEREAS, the 2026 Transportation Capital Improvement Program (CIP) budget includes $500,000 for the County share of CP 97-231; and
WHEREAS, the total estimated cost for oversizing 179th Street (Future County Road 9) to County standards as part of CP 97-231 is $735,903; and
WHEREAS, the City pays 100 percent for the base project costs to construct the road segment to City collector standard and the County/City cost share 55 percent/45 percent respectively in the upsizing cost from City collector standard to County standard per the Dakota County 2040 Transportation Plan (July 2021) Cost Share Policy; and
WHEREAS, the County’s anticipated 55 percent cost share in the oversizing of 179th Street (Future County State Aid Highway 9) with CP 97-231 is $404,747 with final amount to be based on actual construction costs.
NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby authorizes the County Manager or delegate to execute the joint powers agreement with the City of Lakeville to define project cost shares, roles and responsibilities for the design, right of way dedication, construction and maintenance for County Project (CP) 97-231, subject to approval by the County Attorney’s Office as to form.

BACKGROUND
To promote an efficient transportation system throughout Dakota County, Dakota County and the City of Lakeville are partnering on County Project (CP) 97-231 (Attachment: Location Map) for the design, right of way dedication, and construction of portions of 179th Street (Future County State Aid Highway 9). The East-West Corridor study identified Alignment B (179th Street) through the City of Lakeville as a future County minor arterial route. This alignment will serve the transportation needs across multiple local jurisdictions, including Lakeville and Empire, by eventually completing the segment of County Road 9 between County State Aid Highway 23 and Trunk Highway (TH) 3.
The right of way guidelines for the East/West Corridor Preservation corridor for Alignment B is 60 feet of half right of way east of Cedar Avenue for 179th Street. Through the developments of Pheasant Run of Lakeville Eight Addition and Brookshire Second Addition, portions of Alignment B will be constructed as two-lane divided roadway with twin shared-use trail facilities, and all of the necessary right of way will be dedicated to fulfill the County’s 120-foot needs.
The County’s share of the costs for the 179th Street segments is based on the additional cost for a two-lane divided roadway instead of a standard City collector street that would have been
constructed to provide access to the developments. Enhancing the road design now minimizes future costs of expanding the roadway, the adjacent developed property, and the traveling public. Construction is anticipated in fall 2026 or spring 2027.

FINANCIAL AND STAFFING IMPACTS
The 2026 Transportation Capital Improvement Program Adopted Budget for CP 97-231 is $500,000 and is funded by Transportation Fund Balance. Sufficient budget exists for the project.
