PURPOSE/ACTION REQUESTED

Authorize the execution of a consultant contract with Short Elliott Hendrickson Inc. (SEH) for final design services for County Project (CP) 42-174. Execute a joint powers agreement (JPA) with the City of Rosemount to establish cost share and project responsibilities. Authorize a budget amendment to the 2024 Transportation Capital Improvement Program Adopted Budget to add additional funds for project-based County expenses.

 

SUMMARY

To provide a safe and efficient transportation system throughout the County and the region, Dakota County, the City of Rosemount, and the Minnesota Department of Transportation (MnDOT) are partnering on CP 42-174 to improve the existing interchange located at the intersection of County State Aid Highway (CSAH) 42 and US Trunk Highway (TH) 52 (Attachment: Location Map). Project work includes signalization of the TH 52 and CSAH 42 ramps, turn lane additions, and geometric modifications. Final engineering includes MnDOT staff-approved Level 1 geometric layout, final signed plans, final contract approvals, and the bid package for the project. Dakota County is the lead agency.

 

For the CSAH 42/TH 52 interchange area, the primary needs identified include lane continuity/capacity, lowering crash rates, and the mitigation of failing freeway service levels in peak hours based on short- and long-term forecasts. The project includes revising mainline and turn lane geometry, widening along CSAH 42, ramp lane reconfiguration for TH 52 and signalization of the TH 52 and CSAH 42 ramp intersections.

 

This interchange project is planned for spring 2026 construction. $2.4M in already-approved State funding from MnDOT’s Transportation Economic Development (TED) program will cover a major part of the construction budget.

 

Staff issued a request for proposal for final engineering design services for CP 42-174 on May 24, 2024, to seven consultants. MnDOT, City, and County staff received and evaluated three proposals. The table below shows the hours and costs associated with each proposal received.

Short Elliott Hendrickson Inc. is selected based on the most comprehensive project understanding and approach and the best overall value (lowest cost/hour). The SEH project management team has an exceptional knowledge of the area. Last year the same team completed the CSAH 42 Corridor Development study in Rosemount and assisted Dakota County in securing MnDOT’s 2023 TED grant. The 2024 Transportation Capital Improvement Program Adopted Budget includes $350,000 for consulting services. The total budget is comprised of $157,500 in Local Funds and $192,500 in Transportation Sales Tax. This approved budget was based on new Traffic signals on County highways policy F.4 Cost Participation New traffic signal installation 55 percent County share and 45 percent City share. Based on further project development, a revised cost share to county participation policy F.1 Cost Participation - Roadway Principal Arterials - non-Freeway 85 percent County and 15 percent City after applicable state and federal funds is needed to follow the Dakota County highway Cost Share Policy. The future construction JPA will include new Traffic signals policy F.4 Cost Participation is included with a broader highway project 55 percent County share and 45 percent City share. A budget amendment is necessary to correct the approved budget amount to reflect the revised cost share.

 

Additionally, an amendment to the 2024 approved budget amount is necessary to allow for the right of way acquisition process to start in 2024. The 2024 Transportation CIP does not have sufficient funds to start any portion of the right of way process as the project planning dollars accounted for this to occur in 2025.  It is anticipated that the project schedule will allow for appraisal services to commence in late 2024 and project budget is needed to do so.

Staff recommends executing a consultant contract with Short Elliott Hendrickson Inc., for final design engineering services, in an amount not to exceed $349,340, executing a JPA with the City of Rosemount and amending the 2024 Transportation Capital Improvement Adopted Budget.

EXPLANATION OF FISCAL/FTE IMPACTS

The 2024 Transportation Capital Improvement Program (CIP) Budget includes approved funding of $350,000 for consulting engineering services comprised of $157,500 local and $192,500 Transportation Sales Tax. The approved budget reflects a cost share of 55 percent County and 45 percent City based on new Traffic signals on County highways policy F.4 Cost Participation New traffic signal installation. A budget amendment is necessary to revise the cost share to 85 percent County and 15 percent City to follow the Dakota County Highway Cost Share Policy - F.1 Cost Participation for Roadway Principal Arterials - Non-Freeway. The CIP budget for right of way is programmed in the CIP for 2025. A budget amendment is requested to allow appraisal services to start in late 2024.

WHEREAS, to provide a safe and efficient transportation system, Dakota County, in partnership with the City of Rosemount and the Minnesota Department of Transportation (MnDOT), is proceeding with County Project (CP) 42-174; and

 

WHEREAS, CP 42-174 is the final engineering design for the improvement of the existing interchange located at the intersection of County State Aid Highway (CSAH) 42 and US Trunk Highway (TH) 52; and

 

WHEREAS, Dakota County is the lead agency for the project; and

 

WHEREAS, the primary needs identified include lane continuity/capacity, lowering crash rates, and the mitigation of failing freeway service levels in peak hours based on short- and long-term forecasts; and

 

WHEREAS, improvement of the CSAH 42/TH 52 interchange area will enhance traffic safety and intersection operations; and

 

WHEREAS, staff sent a request for proposal to seven qualified professional consultants; and

 

WHEREAS, three proposals were received and evaluated by MnDOT, City, and Dakota County staff; and

 

WHEREAS, Short Elliott Hendrickson Inc. was unanimously selected as the preferred professional design engineering consultant based on the following criteria: best value cost proposal, project approach, project understanding, key project personnel expertise, quality management plan, and past performance on similar projects; and

 

WHEREAS, staff recommends the execution of a contract with Short Elliott Hendrickson Inc. for final engineering design consulting services for CP 42-174 for actual costs not to exceed $349,340; and

 

WHEREAS, the City of Rosemount and MnDOT staff concur with the consultant selection; and

 

WHEREAS, the adopted 2024 Transportation Capital Improvement Program Budget includes $157,5000 in Local Funds and $192,500 in County Transportation Sales Tax funds, totaling $350,000, for County Project 42-174 for final design services; and

 

WHEREAS, the County has secured the State funding of $2.4M through the Minnesota Department of Transportation’s Transportation Economic Development (TED) program, which covers a part of the construction budget; and

 

WHEREAS, a joint powers agreement with the City of Rosemount is necessary to establish project responsibilities and cost share; and

 

WHEREAS, the budget for CP 42-174 requires an amendment to modify the cost-share and to allow for right of way appraisal services to occur in late 2024.

 

NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby authorizes the Physical Development Director to execute the contract with Short Elliott Hendrickson Inc. to perform final design engineering for County Project 42-174 in the amount not to exceed $349,340.00, including reimbursables, subject to approval by the County Attorney’s Office as to form; and

 

BE IT FURTHER RESOLVED, That the Dakota County Board of Commissioners hereby authorizes the Physical Development Director to execute a joint powers agreement with the City of Rosemount, subject to approval by the County Attorney’s Office as to form; and

 

BE IT FURTHER RESOLVED, That the 2024 Transportation Capital Improvement Program Adopted Budget is hereby amended as follow:
