PURPOSE/ACTION REQUESTED

•                     Award bid and authorize a contract with McNamara Contracting Inc. for County Project (CP) 09-64 in the City of Lakeville (City).

•                     Authorization to amend design contract with Stonebrooke Engineering, Inc. to provide additional design.

SUMMARY

Dakota County and the City of Lakeville are collaborating on CP 9-64 to reconstruct Dodd Boulevard from east of County State Aid Highway (CSAH) 23 (Cedar Avenue) to CSAH 31 (Pilot Knob Road) in 2024. By Resolution No. 22-398 (September 20, 2022), the Dakota County Board of Commissioners authorized the execution of a jurisdictional transfer agreement for CSAH 9 and the acceptance of a quit-claim deed for the right of way from the City of Lakeville for 179th Street. Dakota County completed CP 9-56 in 2023, which involved constructing a new four-lane divided alignment of CSAH 9 (179th Street) from Hayes Avenue to CSAH 23. County Projects 9-56 and 9-64 are part of a jurisdictional transfer agreement between the County and the City.

Upon completing CP 9-56 and CP 9-64 improvements, the City and County will transfer the jurisdiction of 179th Street from the City to the County and CSAH 9 from the County to the City. The improvements to Dodd Boulevard bring it up to municipal state aid standards. The county and a city have agreed on the highway improvement in lieu of providing financial payment for jurisdictional transfers based on need. Dodd Boulevard will operate more as a city street with addition of turn lanes and shoulders, lane narrowing, and construction of pedestrian facilities. These improvements will enhance traffic patterns and safety, convert Dodd Boulevard to a city roadway, and provide enhanced east-west access through Dakota County for commuters on the new CSAH 9.

The improvements are a result of the shared interests between Dakota County and the City of Lakeville. They reflect the findings from the County Road 9/179th Street Corridor Study completed in 2019 and the East-West corridor study completed in 2007.

County Project 9-64 construction bids were received and tabulated on January 30, 2024. Four bidders submitted bids as follows:

Bid Name                                                                Total Amount

McNamara Contracting                     $11,016,987.82

Eureka Construction                     $11,518,962.10

Park Construction                     $13,090,072.73

Engineer’s Estimate                     $13,979,889.60

McNamara Contracting Inc.’s CP 9-64 bid of $11,016,987.82 is 21 percent lower than the engineer’s estimate of $13,979,889.60. Staff has reviewed the bids and determined that the bid was competitive at the time of bidding. Staff believes that the engineer’s estimate was high in the areas of Precast Concrete Box Culverts, Excavation, Bituminous Pavement, Loam Topsoil Borrow, Granular Embankment, Bituminous Patching Mixture, Structural Backfill, PVC Pipe Drain, and Mobilization.

The design contract with Stonebrooke Engineering, Inc. will be amended to provide additional design services, including new constructability review meetings, Dodd Boulevard and Cedar Avenue ¾-intersection access re-work, box culvert end section changes, construction assistance on CP 09-56, Foliage Avenue water main extension, and storm sewer plan modifications. Preliminary discussions with the DNR have indicated that a Letter of Map Revision (LOMR) will be required due to the North Creek area regulatory floodplain changes. The City of Lakeville will help facilitate the LOMR process post-construction. This amendment request accommodates Stonebrooke Engineering, Inc. assisting in the LOMR process, as requested by the City.

The third design contract amendment will increase the Contract amount by $130,000 for a total Contract amount not to exceed $1,830,829.00 for professional services related to Final Design Engineering for CP 9-56 and CP 9-64. The amendment represents 8.2 percent of the combined construction cost of $22,224,622.45 for CP 9-56 ($11,207,634.63) and CP 9-64 ($11,016,987.82) and is in line with the typical percentages for designing similar projects with a range from seven percent to eleven percent of the construction costs. A more detailed description of all tasks associated with the scope increase is provided by Stonebrooke Engineering, Inc. (Attachment: Amendment No. 3).
