PURPOSE/ACTION REQUESTED
Award bid and authorize execution of a contract with New Look Contracting, Inc. for County Project (CP) 31-103 in the City of Eagan.
SUMMARY
To promote a safe and efficient transportation system, Dakota County and the City of Eagan are partnering on CP 31-103. The signal reconstruction will occur at County State Aid Highway (CSAH) 31 (Pilot Knob Road) and Corporate Center Drive (Attachment: Location Map).
County Project 31-103 will replace the aging signal system, construct additional turn lanes, and install Americans with Disabilities Act (ADA) compliant ramps, lighting, curb and gutter, sidewalks/trails, and storm sewer at the intersection of CSAH 31 and Corporate Center Drive.
The County is the lead agency for the project with construction anticipated to begin in summer 2024.
By Resolution No. 23-075 (February 28th, 2023), the County Board authorized the execution of a joint powers agreement (JPA) with the City of Eagan to define costs and responsibilities for CP 31-103.
The County issued the project advertisement, and five responsive bids were received and tabulated for CP 31-103 on Friday, June 21st, 2024.

The engineer’s estimate for CP 31-103 is $974,678. Staff reviewed the bids, and the lowest responsible bid is $1,315,829.75 from New Look Contracting, Inc., which is 35 percent above the estimate. Signal system, signing and striping, and grading were the largest work categories contributing to the discrepancy from estimated to bid cost. The current bidding climate as well as small quantities for several items are believed to have influenced the bid cost, as the costs were largely consistent across the contractors. Staff has reviewed the bids and determined the bids competitive.
The County and City will be responsible for the local share at a cost split of 85 percent County and 15 percent City for the turn lane installation and 50 percent County and 50 percent City for signal installation in accordance with the 2040 Dakota County Transportation Plan Cost Policy F.1 per the executed JPA.

EXPLANATION OF FISCAL/FTE IMPACTS
The 2024 Transportation Capital Improvement Program Adopted Budget contains a total budget of $937,833, with $822,521 remaining for CP 31-103. An additional amount of $493,308.75 will be needed and has been requested from the 2024 Transportation Capital Improvement Program Traffic Signal - New/Replacement set-aside to CP 31-103 through an administrative amendment. The referenced set-aside has sufficient funds to accommodate this transfer.

NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby awards the bid to and authorizes the Physical Development Director to execute the contract with New Look Contracting, Inc. for County Project 31-103, in the amount of $1,315,829.75 based on their low bid, subject to approval by the County Attorney’s Office as to form.
