PURPOSE/ACTION REQUESTED
Authorize the Board Chair to execute an Indefeasible Right To Use Agreement (IRU) with Rosemount-Apple Valley-Eagan Public Schools Independent School District (ISD) 196 to provide one strand of dark fiber to the Institutional Network (I-Net).
SUMMARY
The Data Networks Capital Improvement Program (CIP) includes the County’s strategic development of broadband infrastructure to connect County resources to the I-Net. Entering into a IRU with Rosemount-Apple Valley-Eagan Public Schools ISD 196 will provide reliable communication pathway between their respective facilities. The term of the IRU is 10 years and the County will receive $390.00 per year for one strand of fiber within the I-Net.
By Resolution No. 05-165 (April 5, 2005), the Board authorized a joint powers agreement for development of I-Net expansion with the Cities of Apple Valley, Eagan, and Burnsville, ISD 192, 194 and 196, and the State of Minnesota.
Staff recommends the County enter into an IRU (Attachment) with ISD 196 for reliable communication pathway.

Staff recommends the County Board authorize the Board Chair to execute an IRU with ISD 196 for use of the County-owned I-Net backbone to provide a reliable communication pathway between their respective facilities.

EXPLANATION OF FISCAL/FTE IMPACTS
The County will receive $390.00 per year throughout the 10-year term for a total amount of $3,900.

WHEREAS, Dakota County, the Rosemount-Apple Valley-Eagan Public Schools Independent School District (ISD) 196 require a reliable communication pathway between their respective facilities; and
WHEREAS, an Indefeasible Right to Use agreement (IRU) with Rosemount-Apple Valley-Eagan Public Schools ISD 196, is required for the use of Institutional Network (I-Net) segments.
NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby authorizes the Board Chair to execute an Indefeasible Right To Use agreement (IRU) with Rosemount-Apple Valley-Eagan Public Schools Independent School District (ISD) 196 for reliable communication pathway between their respective facilities subject to approval by the County Attorney’s office as to form.
