RESOLUTION

body

WHEREAS, the 2024-2028 Parks Capital Improvement Program Budget includes a project to design and construct a trailhead along Fischer Avenue within Spring Lake Park Reserve; and

WHEREAS, by Resolution No. 24-133 (March 12, 2024), the Dakota County Board of Commissioners awarded a contract with Miller Dunwiddie Architecture, Inc. for the design and related construction administration services; and

WHEREAS, by Resolution No. 24-426 (August 27, 2024), the Dakota County Board of Commissioners approved the schematic design as presented by County staff; and

WHEREAS, by Resolution No. 25-335 (July 8, 2025), the Dakota County Board of Commissioners awarded the general construction contract to Eureka Construction Incorporated in an amount not to exceed $4,235,960; and

WHEREAS, additional scopes emerged during construction, including cold weather acceleration to accommodate the delayed schedule due to the Disadvantaged Business Enterprise review; the difference between actual material quantities used and the assumed unit-price quantities in the bid documents; complications in roof fabrication; and unknown existing site conditions; and

WHEREAS, on July 21, 2026, County staff executed the first contract amendment to increase the contract with Eureka Construction, Incorporated by $190,198 to a total of $4,426,158; and

WHEREAS, now that the project has been completed, an amendment of $65,936 is needed to pay for all remaining additional construction work.

NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby authorizes the County Manager, or delegate, to execute a second contract amendment to increase the contract with Eureka Construction, Incorporated by $65,936 to a total of $4,492,094, subject to approval by the County Attorney’s Office as to form.

BACKGROUND

The project includes a new parking lot, a picnic shelter with restrooms, and a newly paved trail connecting the site to the Mississippi River Greenway. The federal funding involved in the project required it to be managed under the Minnesota Department of Transportation rules for road construction projects. These rules allow for reconciling all quantities used on the project based on unit prices in the original bid (Attachment: Summary of Work Scope Changes).
