WHEREAS, Dakota County Community Corrections currently has a joint powers agreement (JPA) expiring June 30, 2026, with the Minnesota Department of Corrections (MN DOC) to provide secure placement, gender-specific services, necessary assessment, and programming for any juvenile female (“resident”) that Dakota County agrees to accept; and
WHEREAS, Dakota County Community Corrections has complete discretion whether it will accept a particular resident, which will depend on its existing security, health, order and safety needs of its facility, the Juvenile Service Center (JSC), at the time a particular request by the State is made; and
WHEREAS, Dakota County has entered into a new JPA to provide secure programming for juvenile females in an amount not to exceed $295,000 from July 1, 2026 through June 30, 2028; and
WHEREAS, the JPA includes the current daily per diem rate of $475 for 2026 and will not exceed $150,000 per youth.
NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby authorizes the County Manager, or delegate, to execute a joint powers agreement with the Minnesota Department of Corrections to provide secure programming for juvenile females in an amount not to exceed $295,000 effective July 1, 2026 through June 30, 2028, or until completion by the parties of their respective obligations under the joint powers agreement, whichever occurs first, unless earlier terminated by law or according to the provisions of the joint powers agreement, subject to approval by the County Attorney’s Office as to form.

BACKGROUND
The Minnesota Department of Corrections (MN DOC) provides placement and programming for state-committed juvenile males at the Minnesota Correctional Facility-Red Wing. State-committed juvenile females are housed through a contracted facility. Through its partnership with MN DOC, Dakota County Community Corrections provides secure placement, gender-specific services, necessary assessment, and programming for juvenile females referred by MN DOC and accepted for placement at the Dakota County Juvenile Service Center (JSC). Dakota County is one of two facilities currently contracted by MN DOC to provide placement for state-committed juvenile females.
Dakota County Community Corrections retains discretion to accept each referral based on the JSC’s existing security, health, order, safety, staffing, and operational needs at the time of the request.
Youth accepted for placement participate in therapeutic, and evidence-based services designed to address their individual treatment, and supervision needs and enhance public safety.

Staff recommends authorization to execute a joint powers agreement (JPA) with the MN DOC to provide secure programming for juvenile females from the Dakota County Community Services Division effective July 1, 2026 through June 30, 2028, or until completion by the parties of their respective obligations under the JPA, whichever occurs first, unless earlier terminated by law or according to the provisions of the JPA.

FINANCIAL AND STAFFING IMPACTS
This contract is included in the 2026 Community Corrections Amended Budget and will be included in the 2027 County Manager’s Budget. Under the JPA, Dakota County may receive up to $295,000 in revenue from MN DOC for eligible juvenile female placements and programming. Revenue will be receipted to the Juvenile Facility program, Account 42904 (Fees for Juvenile Det Beds). The $295,000 represents the maximum amount available under the JPA and is not guaranteed revenue. MN DOC has not placed a juvenile female with Dakota County in more than two years; therefore, actual revenue may be substantially less or zero. No additional staffing is anticipated as a result of this agreement.
