RESOLUTION

body

WHEREAS, by Resolution No. 20-568 (November 17, 2020), the County Board of Commissioners adopted a Land Conservation Plan for Dakota County (LCP), which included as a goal the establishment of a City-County Collaborative for natural resources planning, protection, and management; and

WHEREAS, the City of Eagan (“City”) and Dakota County recognize that it will be efficient and cost-effective to share resources and cooperate in implementing various natural resources management and restoration projects within the City; and

WHEREAS, the County anticipates providing limited technical and ecological services to the City such as assistance with grant writing, planning, plant and species identification, and similar services where the County’s assistance or collaborative planning will further the goals of the County’s LCP; and

WHEREAS, the City and the County desire to have a single master agreement for all such projects within the City, and to provide for the agreement to be modified over time as projects are added or modified and as cooperative opportunities and implementation efficiencies may change; and

WHEREAS, the initial project identified by this agreement is the production of a natural resources management plan for Patrick Eagan Park; and

WHEREAS, future amendments will be made by adding or updating exhibits as new projects are undertaken.

NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby authorizes the County Manager or delegate to execute a joint powers agreement with the City of Eagan for natural resources restoration projects.

BE IT FURTHER RESOLVED, That the Parks and Greenways Capital Improvement Program Budget is hereby amended as follows:

2000496 CCCC Eagan Patrick Eagan Restoration: $1,920

Total Expense: $1,920

Total Revenue: $1,920

BACKGROUND

The Natural Resources Restoration joint powers agreement (JPA) (Attachment: Draft JPA) uses a previously established standardized, citywide template for collaboration, replacing the need for multiple project-specific agreements for each of these projects. It centralizes information for jointly managed restoration projects in an efficient, transparent format.

A map with the location of Patrick Eagan Park (Attachment: Project Map) is attached.

RECOMMENDATION

recommendation

Staff recommends executing this JPA with Eagan to formalize the ongoing collaboration in alignment with the LCP and to begin work on the natural resources management plan (NRMP) for Patrick Eagan Park.

FINANCIAL AND STAFFING IMPACTS

By Resolution No. 22-334 (August 23, 2022), the Dakota County Board of Commissioners authorized the execution of a grant contract with the State of Minnesota for $6.2 million from the Minnesota Legislature’s 2022 (ML22) Outdoor Heritage Fund (OHF). Grant funding is available until June 30, 2027, and will be used to support the project included in this JPA.

Per the LCP and City-County Conservation Collaborative program guidelines, collaborative projects include a minimum 15% cash or in-kind match from the participating city. Per the JPA, the City of Eagan will reimburse Dakota County for 15% of the contracted cost of preparing an NRMP for Patrick Eagan Park. The requested budget amendment represents new revenue from City of Eagan toward this project.
