WHEREAS, Dakota County is proceeding with County Project (CP) 42-173 to maintain a safe and efficient transportation system; and

 

WHEREAS, CP 42-173 includes pavement milling and overlay and signal replacement improvements at County State Aid Highway (CSAH) 42 (150th Street W) and CSAH 33 (Diamond Path) in the Cities of Apple Valley and Rosemount; and

 

WHEREAS, Dakota County is the lead agency for CP 42-173 with construction planned to begin in spring 2027; and

 

WHEREAS, the original contract with WSB, LLC was authorized for $277,955 (DCA22806) and a first administrative amendment added $36,248, resulting in a total contract value of $314,203 (DCA22806.1); and

 

WHEREAS, additional out-of-scope work is required to complete design revisions, agency coordination, traffic safety improvements, trail and ADA improvements, right-of-way evaluation, utility coordination and construction administration at a cost of $135,396, resulting in a new total contract amount of $449,599; and

 

WHEREAS, the 2026 Transportation Capital Improvement Program Adopted Budget includes sufficient funding.

 

NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby authorizes the County Manager, or Designee, to execute a second amendment to the contract with WSB, LLC, increasing the contract amount by $135,396 resulting in a new contract total not to exceed $449,599, subject to approval by the County Attorney’s Office as to form.

BACKGROUND

Dakota County is in design phase of County Project (CP) 42-173, which will improve the pavement and signal system along County State Aid Highway (CSAH) 42 (150th Street W) from CSAH 33 (Diamond Path) to Trunk Highway 3 (Robert Trail S) in the Cities of Apple Valley and Rosemount. The project includes pavement milling and overlay, replacement of pedestrian ramps to meet Americans with Disabilities Act (ADA) standards, pavement markings, signal improvements at CSAH 33 (Diamond Path), and necessary repairs to local utility systems.

 

As part of pavement preservation projects, Dakota County works with municipal partners to identify utility repairs that can be incorporated into County-led construction projects to reduce repeated disruptions, to save time and costs, and to ensure the corridor is improved comprehensively. Potential utility elements include storm sewer, sanitary sewer, and watermain repairs. The pavement along the corridor has reached the end of its useful life and exhibits severe cracking, failing curb, and noncompliant pedestrian features. Accessible pedestrian signals and other system elements will be updated at all signalized intersections.

 

CSAH funds will be used to deliver pavement and ADA improvements.

 

The project scope has evolved, and additional design services are required to maintain the planned construction schedule for 2027. Staff requested a quote from WSB, LLC for out-of-scope services required to complete the project for planned construction in 2027 utilizing State funding. The proposed second amendment includes:

 

                     Design add-on for intersection safety improvements at CSAH 42 and Canada Ave. ($58,360)

                     Analyzing offset left-turn and right-turn operations at Diamond Path and CSAH 42. ($12,490)

                     Incorporating design sheets for offset left-turn improvements at the Diamond Path intersection. ($12,490)

                     Coordinating with State Aid and federal aid staff to revise project limits for an adjacent project based on safety improvements involving left- and right-turn lane offsets. ($12,490)

                     Adding the southwest trail connection and related ADA improvements. ($6,245)

                     Evaluating ADA ramp impacts and right-of-way needs. ($12,490)

                     Preparing parcel sketches and conducting additional ROW coordination. ($20,264)

                     Tracking State Aid funding for pavement, ADA, and signal improvements. ($3,122)

                     Adding trail improvements along the south side of CSAH 42 between Canada Avenue and Trunk Highway 3 (Robert Trail S). ($6,245)

                     Providing construction administration assistance for site complexities, construction issues and help mitigate delays. ($15,336)

                     Total additional services: $159,532

The original contract included unused tasks at the time of amendment request. The County will receive credits for the unused tasks as part of the second amendment.

 

                     Credit for unused Task 2 Public and Agency Involvement services ($16,468)

                     Credit for original 50-hour Construction Supplemental Assistance allowance ($7,668)

                     Total credit: $24,136

FINANCIAL AND STAFFING IMPACTS

The 2026 Transportation Capital Improvement Program (CIP) Adopted Budget includes $3,977,995 for CP 42-173. The proposed contract amendment of $135,396 is funded by CSAH and Transportation funds. Sufficient budget exists for this recommended action. This request has no impact on County FTEs.
