BACKGROUND

By Resolution No. 22-255 (June 21, 2022), Dakota County executed a lease of approximately 52 acres of land in the City of Empire to Specialized Environmental Technologies, Inc. (SET) for solid waste management purposes. SET is licensed and permitted to operate a source-separated organics composting facility, a yard waste composting facility, and a mixed municipal solid waste transfer station, and SET is the operator of the facilities. The lease requires SET to indemnify the County for SET’s operations on the land.

MPCA Permit Modification Application

As a result of the MPCA permit modification review process, SET is required to submit a completed MPCA Permit Application. As the landowner, Dakota County is required to sign as a co-permittee with SET (Minn. Rules, Part 7001.0060[E]).

RECOMMENDATION
