WHEREAS, to provide a safe and efficient transportation system, Dakota County (County) is participating with the Minnesota Department of Transportation (MnDOT) on County Project (CP) 99-028; and

 

WHEREAS, CP 99-028 is the MnDOT-led Trunk Highway (TH) 13 at Nicollet Avenue grade separation to improve safety and mobility along the state’s system; and

 

WHEREAS, MnDOT is leading all phases of the project with construction anticipated to start in 2027 with completion expected at the end of 2028; and

 

WHEREAS, Dakota County does not have any jurisdictional roads included in MnDOT’s TH13 improvements other than detour routes; and

 

WHEREAS, Agreement No. 1063649 is necessary to convey the $2,000,000 County commitment to MnDOT for the project; and

 

WHEREAS, the 2026 Transportation Capital Improvement Program (CIP) Adopted Budget includes $2,000,000 in Transportation Sales and Use Tax for CP 99-028; and

 

WHEREAS, MnDOT and the County mutually desire to enter into Agreement No. 1063649 as needed to define the costs and responsibilities associated with the construction, operations and maintenance for MnDOT’s TH 13 and Nicollet Avenue grade separation project, CP 99-028; and

 

WHEREAS, the County Engineer recommends authorizing staff to enter into Agreement No. 1063649 with MnDOT for CP 99-028.

 

NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby authorizes the County Manager, or delegate, to execute Agreement No. 1063649 with the State of Minnesota, Department of Transportation for the Trunk Highway No. 13 at Nicollet Avenue construction under State Project No. 1901-207, County Project 99-028, subject to approval by the County Attorney’s Office as to form.

BACKGROUND

The Minnesota Department of Transportation (MnDOT) has partnered with Savage, Burnsville, Scott County, and Dakota County to complete improvements to the Trunk Highway (TH) 13 corridor within the city limits of Savage and Burnsville. The TH 13 improvements are aimed at improving safety and reducing congestion along the TH 13 system primarily by grade-separating existing at-grade intersections and reconstructing of the corridor. The overall project is being accomplished in phases with Segments 1 and 2 including work within Savage and Burnsville from Quentin Avenue to Washburn Avenue along TH13.  Segment 3 includes the grade separation of TH13 and Nicollet Avenue, which includes the $2,000,000 in Transportation Sales and Use Tax committed by Dakota County.

 

The project scope and limits do not impact a Dakota County facility, and thus the MnDOT cost participation policy does not apply. The Dakota County Board of Commissioners elected to partner with the agencies with a commitment of Transportation Sales and Use Tax by way of a lump sum payment, not to exceed, $2,000,000.

 

Construction of Segment 3 for Nicollet Ave and TH 13 will begin in 2027 with anticipated completion in late 2028.  Segments 2 and 3 are anticipated to start in 2029. A future agreement will be necessary with the State to define details of traffic detouring onto Dakota County systems during the various stages of construction for Segments 1-3.

FINANCIAL AND STAFFING IMPACTS

The 2026 Transportation Capital Improvement Program Adopted Budget for County Project 99-028 is $2,000,000 and is funded by Transportation Sales and Use Tax. Sufficient budget exists for the project.
