PURPOSE/ACTION REQUESTED

Authorize execution of agreement with Great River Energy for the reinforcement of their existing electric transmission poles and associated impacts along County State Aid Highway (CSAH) 91 for County Project (CP) 91-29.

 

SUMMARY

To provide a safe and efficient transportation system, Dakota County is proceeding with County Project 91-29, which includes the reconstruction of County State Aid Highway (CSAH) 91 (Nicolai Avenue) from 210th Street to Trunk Highway 316 (Red Wing Boulevard) in Marshan Township (see Attachment: Location Map). Dakota County is the lead agency, with construction planned for the summer of 2023.

 

Great River Energy (GRE) operates a transmission line within its own easement along a portion of CSAH 91 and CSAH 62 (190th Street). In effort to minimize impacts that would require the relocation of the transmission line, the alignment of CSAH 91 was shifted. Despite this shift of alignment, the project will encroach on GRE’s easement and facilities including the transmission poles at the intersection of CSAH 62 (190th Street) and CSAH 91. Since GRE owns the easement, the County is responsible for the costs to reinforce the transmission line poles and any necessary pole relocation work, as it is a project-related impact.

 

In Fall 2022, the County and GRE entered into an engineering review agreement to review the project’s impacts on GRE’s facilities. GRE has reviewed the project impacts and requires reinforcement for 19 transmission line poles. Based on this review, GRE has provided an estimate on the relocation costs of $171,974.00 and the associated modification/relocation agreement. Staff has reviewed the engineering determination agreement and proposed costs (see Attachment: Draft GRE Agreement).

Staff recommends the execution of the modification/relocation agreement with GRE for the necessary pole reinforcement work required based on the CP 91-29’s encroachment on their facilities to proceed in an amount not to exceed $171,974.00.

EXPLANATION OF FISCAL/FTE IMPACTS

The 2023 Transportation Capital Improvement Program budget includes $7,660,200 in funding for CP 91-29. Sufficient funds are available for CP 91-29 (see Attachment: Financial Summary).

WHEREAS, to provide a safe and efficient transportation system, Dakota County is proceeding with County Project (CP) 91-29; and

 

WHEREAS, CP 91-29 will reconstruct County State Aid Highway (CSAH) 91 (Nicolai Avenue) from 210th Street to Trunk Highway 316 (Red Wing Boulevard) in Marshan Township, improve drainage and replace culverts; and

 

WHEREAS, to address the purpose and need for this Project, safety will be improved along the corridor by improving the roadway surface, adding turn lanes, and improving drainage; and

 

WHEREAS, Dakota County is the lead agency for CP 91-29; and

 

WHEREAS, Great River Energy (GRE) operates a transmission line within its own easement along CSAH 91 and CSAH 62 (190th Street); and

 

WHEREAS, CP 91-29’s alignment was shifted to minimize impacts on GRE’s transmission line; and

 

WHEREAS, Despite alignment shift, the project is encroaching on GRE’s easement and facilities including the transmission poles along CSAH 62 at its intersection with CSAH 91; and

 

WHEREAS, Dakota County and GRE entered into an engineering review agreement for the review of the CP 91-29’s impact on GRE’s easement and facilities; and

 

WHEREAS, GRE has completed their review and requires reinforcement at 19 poles along the project corridor; and

 

WHEREAS, GRE estimates that the cost to complete the reinforcement and relocation work is $171,974.00; and

 

WHEREAS, to proceed with CP 91-29, Dakota County must enter into a modification/relocation agreement with GRE to complete the necessary work on GRE’s facilities for the project; and

 

WHEREAS, the 2023 Transportation Capital Improvement Budget has sufficient funding for the necessary GRE work; and

 

WHEREAS, staff recommends execution of a modification/relocation agreement with GRE for the estimated amount of $171,974.00.

 

NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby authorizes the Physical Development Director to execute a modification/relocation agreement with Great River Energy for the necessary work on Great River Energy’s facilities within their existing transmission line easement for County Project 91-29 in the amount of the actual costs currently estimated at $171,974.00, subject to approval by the County Attorney’s Office as to form.
