PURPOSE/ACTION REQUESTED

Authorize execution of a second and final contract amendment with Wold Architects and Engineers for the design of the Law Enforcement Center’s (LEC) Integrative Health Unit (IHU) Addition. Board action is required as the value of total amendments after initial authorization of the contract execution exceeds a policy limit of $50,000.

 

SUMMARY

The LEC IHU Addition project was first considered nearly three years ago, and construction is now complete. The design contract was awarded to Wold Architects and Engineers in the sum of $675,000 by Resolution No. 22-257 (June 21, 2022). The schematic design for the project was presented by Resolution No. 22-480 (November 15, 2022), and the scope of the project had then increased sufficiently that near the end of design, Wold requested an amendment to their contract to account for such changes. An amendment to the design contract with Wold Architects and Engineers in the sum of $135,000 was authorized by Resolution No. 23-264 (June 20, 2023). That brought Wold’s contract total to $810,000, which included $24,000 in estimated reimbursable expenses.

 

In this action, staff is requesting a second contract amendment with Wold Architects and Engineers in the sum of $8,488.49 for reimbursable plan review costs that exceeded the earlier estimated amounts. Plan reviews by the State of Minnesota, the Department of Corrections, and the City of Hastings were all required for the project. These fees were $32,488.49 and exceeded the estimated $24,000. Wold is therefore asking for an amendment to their contract of $8,488.49 to account for the increase. This increase to the design contract will be paid for with reserved funds remaining within the original project budget.

A $135,000.00 contract amendment has already been authorized by Resolution No. 23-264 (June 20, 2023). Staff recommends authorizing a second contract amendment with Wold Architects and Engineers in the sum of $8,488.49 for plan review fees incurred at the LEC IHU. This brings the total authorized contract amendments to this contract to $143,488.49 and the new contract value to $818,488.49.

EXPLANATION OF FISCAL/FTE IMPACTS

Funds totaling $14,400,000 were included in the earlier adopted Capital Improvement Program budget for the design and construction of the LEC IHU Addition. Sufficient funds within the project (1001292) budget are available for this amendment.

WHEREAS, the 2023 Capital Improvement Program (CIP) Adopted Budget, as amended for the Law Enforcement Center (LEC) Integrative Health Unit (IHU) Addition project, is a total of $14,400,000; and

 

WHEREAS, by Resolution No. 22-257 (June 21, 2022), the County Board approved the original contract for design in the sum of $675,000 with an award to Wold Architects and Engineers; and

 

WHEREAS, by Resolution No. 23-264 (June 20, 2023), the County Board approved a first amendment in the sum of $135,000 to the design contract with Wold Architects and Engineers; and

 

WHEREAS, an additional $8,488.49 worth of reimbursed plan review fees for reimbursement to Wold Architects and Engineers is requested for authorization to complete a second contract amendment to the contract with Wold Architects and Engineers; and

 

WHEREAS, these project cost increases to the construction contract will be paid for with uncommitted funds available within the CIP budget for this project; and

 

WHEREAS, the total authorized contract amendments to this contract would then be $143,488.49; and

 

WHEREAS, sufficient funds within the CIP budget for the project (1001292) are available for this amendment.

 

NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby authorizes the Facilities Management Director to execute a contract amendment with Wold Architects and Engineers, 332 Minnesota Street, Suite W2000, St. Paul, MN 55101 in an amount not to exceed $8,488.49 for a total maximum contract total not to exceed $818,488.49, subject to approval by the County Attorney’s office as to form.
