WHEREAS, by Resolution No. 26-335 (August 4, 2026), the Dakota County Board of Commissioners concurred with the State Aid variance request for a reduced horizontal trail radius of thirty-eight feet along County State Aid Highway (CSAH) 9; and
WHEREAS, the Minnesota Department of Transportation (MnDOT) subsequently informed Dakota County that the variance request must also specify the proposed reduced minimum design speed of fourteen miles per hour and identify the horizontal curve station limits between Stations 58+09 and 58+64 in order to comply with Minnesota Rules, Part 8820.9995; and
WHEREAS, on August 19, 2026, MnDOT State Aid clarified that these additional technical elements must be included in an amended resolution before forwarding the variance package to the Variance Advisory Committee; and
WHEREAS, the amendment is technical in nature and does not alter the design, scope, cost, or prior concurrence actions previously approved by Resolution No. 26-335 (August 4, 2026).
NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby amends Resolution No. 26-335 (August 4, 2026) to specify that the reduced horizontal trail radius of thirty eight feet applies to the shared use path segment between Stations 58+09 and 58+64 and that the County proposes a reduced minimum design speed of fourteen miles per hour for this segment; and
BE IT FURTHER RESOLVED, That all other provisions of Resolution No. 26-335 remain in full force and effect; and
BE IT FURTHER RESOLVED, That the Dakota County Board of Commissioners directs Transportation Department staff to transmit this amended resolution to MnDOT State Aid for Local Transportation as part of the formal variance request package.

BACKGROUND
On August 4, 2026, by Resolution No. 26-335, the Dakota County Board of Commissioners concurred with a State Aid variance request for a reduced horizontal trail radius needed due to right-of-way constraints along County State Aid Highway (CSAH) 9. After reviewing the variance package, the Minnesota Department of Transportation (MnDOT) informed Dakota County that the resolution must also specify the proposed reduced minimum design speed and identify the horizontal curve station limits required under Minnesota Rules, Part 8820.9995.
On August 19, 2026, MnDOT State Aid clarified that the variance request must include a proposed minimum design speed of fourteen miles per hour, in lieu of the required twenty miles per hour, and list the station limits between Stations 58+09 and 58+64. MnDOT requires these technical elements before forwarding the request to the Variance Advisory Committee.
The proposed amendment adds these details to the previously approved resolution. The amendment does not change the design, scope, cost, or impacts reviewed by the Board in August. Instead, it provides the required technical information so MnDOT can complete its formal variance review.
Dakota County is the governmental unit responsible for CSAH 9 and the Lake Marion Greenway segment. The City of Lakeville continues assisting as project lead under the joint powers agreement because this segment is a city priority improvement.
Summary
MnDOT State Aid identified two items missing from Resolution No. 26-335 that must be included for the variance package to proceed: the proposed reduced minimum design speed of fourteen miles per hour and the horizontal curve station limits between Stations 58+09 and 58+64. The amendment supplements, but does not change, the County’s previous concurrence or indemnification.
