WHEREAS, the Buildings Capital Improvement Program (CIP) budget for the Law Enforcement Center Interior Renovations project includes a total budget of $3,820,000; and
WHEREAS, by Resolution No. 22-403 (September 20, 2022), the County Board approved the original contract in the sum of $3,102,000 with an award to Shaw-Lundquist Associates, Inc.; and
WHEREAS, on October 10, 2022, Dakota County entered into a contract with Shaw-Lundquist Associates, Inc. for general contracting services for a total amount not to exceed $3,102,000 (“Expired Contract”); and
WHEREAS, the Expired Contract expired on June 26, 2023; and
WHEREAS, with the original contract authorization, staff was also authorized to execute up to $100,000 worth of post-award changes; and
WHEREAS, a total of $78,770.32 in contract amendments has already been formally executed by way of that authorization; and
WHEREAS, an additional $122,423.20 worth of post-award changes is requested for authorization to close-out the project with Shaw-Lundquist Associates, Inc.; and
WHEREAS, these project cost increases to the original construction contract will be paid for with uncommitted funds available within the CIP budget; and
WHEREAS, staff recommends authorizing a contract with Shaw-Lundquist Associates, Inc. to reinstate the terms of the Expired Contract, increase the Expired Contract amount by $201,193.52, for a total combined amount not to exceed $3,303,193.52 and extend the term to December 31, 2023; and
WHEREAS, the total increase to close-out this contract would then be $201,193.52 for reimbursement of all construction change orders on the project; and
WHEREAS, sufficient funding within the Buildings Capital Improvements Program budget for the project (B20029) are available for this amendment; and
WHEREAS, the Facilities Management Department recommends executing a contract with Shaw-Lundquist Associates, Inc. to reinstate the terms of the Expired Contract, increase the original contract amount and extend the term to December 31, 2023;
NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby authorizes the Parks, Facilities, and Fleet Management Director to execute a contract with Shaw-Lundquist Associates, Inc. 2757 West Service Road, Saint. Paul, MN 55121, reinstating the terms of the Expired Contract, increasing the Expired Contract amount by $201,193.52, for a total combined amount not to exceed $3,303,193.52 and extending the term to December 31, 2023, subject to approval by the County Attorney’s office as to form.
