RESOLUTION

body

WHEREAS, opioid settlement funds are distributed and governed by the Amended Minnesota Opioid State-Subdivision Memorandum of Agreement (MOA), which sets forth authorized strategies in MOA Exhibit A; and

WHEREAS, by Resolution No. 24-256 (May 21, 2024), the Dakota County Board of Commissioners authorized the Community Services Director to execute a Joint Powers Agreement (JPA) with Independent School District 199 (ISD 199) in an amount not to exceed $4,000 using opioid settlement funds for MOA Exhibit A strategies G.8, G.9, G.10, H.1, H.3, H.4, H.6, and H.7, for a term from April 25, 2025, through January 1, 2027; and

WHEREAS, by prior resolution, the Dakota County Board of Commissioners authorized an amendment to the 2024 Non-Departmental Budget to allocate up to $80,000 in opioid settlement funds for reimbursement of up to $500 per school building in Dakota County for eligible activities consistent with the MOA, including storage for mandated nasal naloxone, training, and support for community education and outreach; and

WHEREAS, in connection with that allocation, staff recommended entering into JPAs with Independent School Districts (ISD)s 192, 194, 196, 197, and 199, and Special School District 6 (SSD 6), to support eligible opioid awareness activities, opioid response training, and training equipment, with terms beginning upon execution and originally anticipated to end July 1, 2025; however, the executed JPAs have terms that run through January 1, 2027; and

WHEREAS, the JPAs provide the same funding opportunity, and ISDs 192, 194, 196, and 197 and SSD 6 have spent, or expect to spend, their allocated funds by January 1, 2027; and

WHEREAS, ISD 199 requires additional time to implement planned curriculum and has requested that its JPA term be extended through January 1, 2028; and

NOW, THEREFORE, BE IT RESOLVED, that the Dakota County Board of Commissioners hereby ratifies the joint powers agreements with school districts: SSD 6; ISD 192; ISD 194; ISD 196; ISD 197; and ISD 199, with terms through January 1, 2027, and authorizes the expenditures identified in those agreements to be made through January 1, 2027; and

BE IT FURTHER RESOLVED, that the Dakota County Board of Commissioners hereby authorizes an amendment to the Joint Powers Agreement with Independent School District 199, using opioid settlement funds for opioid awareness activities, opioid response training, and equipment for training, to extend the term through January 1, 2028, in accordance with the Amended Minnesota Opioid State-Subdivision Memorandum of Agreement (MOA) Exhibit A strategy items G.8, G.9, G.10, H.1, H.3, H.4, H.6, and H.7, subject to approval by the County Attorney’s Office as to form.

BACKGROUND

The Dakota County Board of Commissioners is being asked to ratify the existing joint powers agreements (JPA)s with Special School District (SSD) 6 and Independent School Districts (ISD)s 192, 194, 196, 197, and 199. The agreements were executed with terms through January 1, 2027, although the original staff recommendation anticipated terms ending July 1, 2025. The JPAs support eligible opioid awareness activities, opioid response training, and training equipment using opioid settlement funds, including reimbursement of up to $500 per school building. The other participating districts have spent, or expect to spend, their allocations by January 1, 2027. ISD 199 has requested additional time to implement planned curriculum; therefore, staff is recommending that the Board also authorize an amendment extending the ISD 199 JPA term through January 1, 2028. The extension does not authorize expenditures.
