WHEREAS, to provide a safe and efficient transportation system, Dakota County proceeded with County Project (CP) 56-07 to reconstruct 1.1 miles of County State Aid Highway (CSAH) 56 between 65th Street in Inver Grove Heights and 1,100 feet south of Dale Place in South St. Paul; and
WHEREAS, modifications to the curve between Polar Street and Chestnut Street in South St. Paul required the total take acquisition and relocation of four single family homes along CSAH 56; and
WHEREAS, after construction was completed for CP 56-07, remnant parcels remain as open space and have been identified as no longer serving a public purpose for Dakota County; and
WHEREAS, the Dakota County Community Development Agency (CDA) has acquired two adjacent properties along CSAH 56 and identified these four remnant parcels as having the potential for a new multifamily development; and
WHEREAS, the Dakota County Plat Commission and Transportation staff have established the new right of way boundary along the remnant parcels, reserving the necessary right of way and confirming the excess land available to sell to the CDA; and
WHEREAS, the CDA hired an independent appraiser, Nagell Appraisals, to value the available remnant parcels and establish the sale price of $178,000; and
WHEREAS, the CDA has made an offer to purchase the remnant parcels in fee title, subject to the right of way established by Dakota County; and
WHEREAS, County turnback funds were used to acquire the properties and any sale proceeds would be eligible to go back to the Transportation Fund.
NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby approves the sale and conveyance of excess County property along County State Aid Highway 56 to the Community Development Agency, in the amount of $178,000 to the County Transportation Fund; and
BE IT FURTHER RESOLVED, That the Dakota County Board of Commissioners hereby authorizes the County Manager or delegate to execute a purchase agreement with the Dakota County Community Development Agency for the sale of Tax Parcel IDs 36-45300-11-220, 36-45300-11-200, 36-45300-11-191, and 36-45300-11-170, subject to approval by the County Attorney’s Office as to form; and
BE IT FURTHER RESOLVED, That the Dakota County Board of Commissioners hereby authorizes the County Board Chair to execute a quit claim deed conveying the County’s interest in Tax Parcel IDs 36-45300-11-220, 36-45300-11-200, 36-45300-11-191, and 36-45300-11-170, legally described as Lots 16 through 22, Block 11, LINCOLN PARK ADDITION, according to the recorded plat thereof, Dakota County, Minnesota, to the Dakota County Community Development Agency, subject to approval by the County Attorney’s Office as to form.

BACKGROUND
Over the course of County Project (CP) 56-07, the County was able to reach negotiated settlements with all four homeowners and relocate them to new properties. During the construction phase of the project, the homes were demolished and driveway accesses to CSAH 56 were removed to make room for the roadway and trail.
The CDA was able to purchase properties adjacent to the vacant lots to provide them with enough land for a proposed townhome development. County staff is supportive of this development as all access would come from local road connections and no direct access to CSAH 56 would be established from these properties.
The Dakota County Plat Commission has reviewed the properties and established a five-foot clear zone beyond the existing trail that will be reserved for right of way purposes. Beyond that clear zone, the County did not see a need for continued ownership of the parcels.
Funding sources used for the acquisition and relocation of these parcels on CP 56-07 were County Turnback funds, so there are no restrictions on the sale or proceeds received. By selling the excess properties to the CDA for redevelopment at appraised value, the County can recoup costs that would go back to Transportation general fund and provide new housing for County residents.

Staff recommends authorizing the signing of the purchase agreement to sell excess property to the CDA and granting the Board Chair authority to sign the warranty deed conveying the land to the CDA.

FINANCIAL AND STAFFING IMPACTS
The total sales price for the four parcels of $178,000 would be eligible to go back to the Transportation Fund to be used on future transportation-related projects.
