PURPOSE/ACTION REQUESTED
Award bid and authorize a contract with McNamara Contracting, Inc. for the 2024 Preservation of Paved Trails and Facilities and amend the adopted 2024 Transportation Capital Improvement Program (CIP) Budget.
SUMMARY
To promote a safe and efficient transportation system, Dakota County is proceeding with the 2024 preservation of paved trails and facilities projects (Attachment: Location Map). The 2024 preservation work includes pavement mill and overlay of parking lots, pavement reclamation of trails and a parking lot, and application of pavement markings.
Timeline: Construction is scheduled to begin in summer 2024 and be completed by late fall 2024.
Bids Received: Bids were received and tabulated on June 25, 2024. Three bidders submitted bids as follows:
McNamara Contracting, Inc. $1,379,518.00
OMG $1,590,256.86
Bituminous Roadways $1,792,720.40
The engineer’s estimate for the 2024 Preservation of Paved Trails and Facilities is $1,888,895.00. The lowest responsive and responsible bid is $1,379,518.00 from McNamara Contracting, Inc., which is 27 percent under the estimate. Staff has reviewed the bids and determined that the low bid was competitive at the time of bidding.
The total project budget needed is $1,408,418.00. The total share of project costs from the 2024 Transportation Capital Improvement Program Adopted Budget is $802,967.00. The additional $605,451.00 will be paid for using the parks and facilities set-asides.

EXPLANATION OF FISCAL/FTE IMPACTS
The 2024 Transportation CIP Adopted Budget includes $1,100,000 for Pedestrian and Bicycle Facilities. The 2024 Parks CIP Adopted Budget includes a total of $1,500,000 for Greenway Preservation and Parks Asset Preservation projects. The 2024 Facilities CIP adopted budget includes $200,000 for Parking Lots Seal & Repair. Sufficient funds exist in the various funding sources for a total budget of $2,800,000 for the 2024 preservation of paved trails and facilities projects. A budget amendment to the 2024 Transportation CIP Adopted Budget is necessary to shift money from the set-asides to the individual projects and assign $20,000 for administrative project costs and materials sampling and testing to be performed by the Minnesota Department of Transportation in accordance with State of Minnesota Master Partnership Agreement 1050146 (Dakota County Contract C0035533).

WHEREAS, to provide a safe and efficient transportation system, Dakota County is proceeding with the 2024 Preservation of Paved Trails and Facilities Projects; and
WHEREAS, the projects to be completed in 2024 include County Projects 28-71, 31-116, 31-117, 32-114, 43-58, 46-62, 98-41, 98-42, 98-43, 98-45, 98-46, 98-48, and 98-50; and
WHEREAS, the preservation work is scheduled for construction in 2024; and
WHEREAS, the 2024 Transportation Capital Improvement Program (CIP) Adopted Budget includes funding for Pedestrian & Bicycle Facilities; and
WHEREAS, the 2024 Parks CIP Adopted Budget includes funding for Greenway Preservation and Parks Asset Preservation; and
WHEREAS, the 2024 Facilities CIP Adopted Budget includes funding for Parking Lots Seal & Repair; and
WHEREAS, three bids were received for the 2024 preservation of paved trails and facilities projects on June 25, 2024; and
WHEREAS, the bid of McNamara Contracting, Inc. in the amount of $1,379,518.00 was the lowest responsive and responsible bid received; and
WHEREAS, an amendment to the 2024 Transportation CIP Budget is necessary to shift funds from the set-asides to the individual projects; and
WHEREAS, staff recommends awarding the bid to and authorizing the execution of a contract with McNamara Contracting, Inc. and amending the 2024 Transportation CIP.
NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby awards the bid and authorizes the Physical Development Director to execute a contract with McNamara Contracting, Inc. for the 2024 preservation of paved trails and facilities projects, subject to approval by the County Attorney’s Office as to form; and
BE IT FURTHER RESOLVED, That the 2024 Transportation Capital Improvement Program Adopted Budget is hereby amended as follows:
