Authorization To Execute Amended Cooperative Agreement With State Of Minnesota For Minnesota River Greenway In Burnsville And Eagan, County Project P00127

PURPOSE/ACTION REQUESTED

Amend Cooperative Agreement C0028829.2 with the Minnesota DNR for construction and operation of the Minnesota River Greenway to better reflect current project area and construction needs.

SUMMARY

Dakota County is proceeding with the Minnesota River Greenway (MNRGW) Fort Snelling Segment (P00127) to construct 3.7 miles of the Minnesota River Greenway between trailheads located near Nicols Road and Lone Oak Road in Eagan, including a pedestrian bridge to cross over railroad-owned by Union Pacific (Attachment: Project Area Map). By Resolution No.16-516 (October 11, 2016), the County executed a cooperative agreement (C0028829) with the Minnesota Department of Natural Resources (DNR) to enable construction of a portion of the Big Rivers Regional Trail within Fort Snelling State Park; the cooperative agreement assigns roles and responsibilities for construction, operation, and maintenance of the trail. This cooperative agreement was amended by Resolution No. 22-464 (November 1, 2022) to include the entire alignment for the MNRGW Fort Snelling Segment and redefine the project area based on design needs. Dakota County does not assume any interest in the DNR’s property through this agreement.

The project is advancing into the construction phase. County staff and the construction management consultant reviewed the anticipated construction process and have identified a need to expand the construction area defined in the cooperative agreement (Attachment: Bridge Construction Area Map). This need has arisen from a better understanding of both the type and placement of equipment necessary to construct the bridge, given constraints in the area. With this change in project footprint, County and DNR staff have determined that the cooperative agreement exhibits need to be updated to more accurately reflect the project’s needs during construction.
