PURPOSE/ACTION REQUESTED

Approve acquisition of right of way necessary for the North Creek Greenway Lakeville-Farmington Segment (P00146) construction in the City of Farmington (see Attachment: Project Location Map).

 

SUMMARY

To provide a safe and efficient greenway system, Dakota County is proceeding with the North Creek Greenway Lakeville-Farmington Segment Project, which is the construction of 2.2 miles of shared-use trail along North Creek and nearby tributaries and wetlands from East Lake Community Park in Lakeville at 173rd Street West to Jim Bell Park and Preserve in Farmington at 189th Street West. The design includes a ten-foot shared-use trail, two new trail bridges which cross North Creek, a tributary stream, trail nodes, connections to local trails and city parks, and two improved local street crossings. The project is currently scheduled for construction beginning in the spring of 2023.

 

The purpose of the project is to complete a segment of the North Creek Greenway utilizing existing City and County property and parkland. Upon completion, this trail segment will provide a connection to East Lake Community Park, Jim Bell Park and Preserve, and other local parks. Other projects, current, and future, will connect this trail segment to points north in Apple Valley and Eagan and to downtown Farmington. This year-round facility will serve people of diverse interests and abilities while protecting and enhancing the natural surroundings. Additionally, this facility will provide a safe and efficient route for pedestrian and bicycle transportation in the area.

 

Dakota County is the lead agency for the design and right of way acquisition. Acquisition of temporary construction easements from six private parcels (see Attachment: Parcel Map) is recommended to move forward with the construction of the North Creek Greenway Lakeville-Farmington Segment. Federal funding of this project in the amount of $480,000 has been awarded through Regional Solicitation. Federal authorization associated with the Regional Solicitation funding award requires that right of way be fully secured prior to bidding for construction.

 

The appraisals consist of acquisitions of temporary easements from private residences or vacant land for construction access, minor grading, and restoration due to existing trail removal, trail relocation, and reconstruction. Valbridge Property Advisors has completed appraisals with a total appraised value of $12,950.00. Appraisal data has been provided to the County Board in a separate confidential spreadsheet, as the appraisals are confidential, non-public data pursuant to Minn. Stat. § Sec. 13.44, subd. 3.

EXPLANATION OF FISCAL/FTE IMPACTS

Acquistion costs are paid by the P00040 Acquisition Set-Aside in the Parks Capital Improvement Program (see Attachment: Financial Summary). Sufficient funds are available for the recommended right of way acquisition totaling $12,950.00.

WHEREAS, to provide a safe and efficient greenway system, Dakota County is proceeding with the North Creek Greenway Lakeville-Farmington Segment Project (P00146); and

 

WHEREAS, the purpose of the project is the construction and improvement of 2.2 miles of the North Creek Greenway from its connection to East Lake Park at 173rd St W in Lakeville to Jim Bell Park and Preserve in Farmington; and

 

WHEREAS, Dakota County is the lead agency for the Project; and

 

WHEREAS, right of way acquisition is needed to allow for construction to begin in 2023 as scheduled; and

 

WHEREAS, to move forward with the construction of the Project, the acquisition of temporary easements on six parcels is necessary, as identified in the Parcel Map attachment; and

 

WHEREAS, the acquisition of the following six parcels is necessary to move forward with the Project:

A temporary easement for construction purposes over, under, across, and through part of the following described property:

 

Lot 36, Block 4, MEADOW CREEK 3RD ADDITION

 

Said temporary easement being the Southeasterly 5.00 feet of the Northeasterly 30.00 feet of said Lot 36.

 

Together with a temporary easement for construction purposes over, under, across, and through the Northwesterly 5.00 feet of the Southeasterly 10.00 feet of the Northeasterly 10.00 feet of said Lot 36.

WHEREAS, appraisals have been completed for six parcels by Valbridge Property Advisors for a total appraised value of $12,950.00; and

 

WHEREAS, the 2022 Parks Capital Improvement Program Budget includes sufficient funds for the right of way acquisitions required by the Project.

 

NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby approves the appraised values prepared by Valbridge Property Advisors for the acquisition of the right of way for the North Creek Greenway Lakeville-Farmington Segment and authorizes County staff, in its discretion, to share the appraisal data with the respective landowners, including all or portions of the completed appraisals as part of the negotiation process; and

 

BE IT FURTHER RESOLVED, That the Dakota County Board of Commissioners hereby approves the acquisition of right of way for the North Creek Greenway Lakeville-Farmington Segment at the approved appraised values and in accordance with County policy and authorizes payment from the adopted 2022 Parks Capital Improvement Program budget.
