PURPOSE/ACTION REQUESTED

Approve right of way acquisition and quick-take condemnation for County Project (CP) 50-37, (Attachment: Project Location Map) Roundabout at the Intersection of County State Aid Highway (CSAH) 50 (202nd Street West) and Hamburg Avenue in City of Lakeville.

 

SUMMARY

To provide a safe and efficient transportation system, Dakota County staff continuously monitors intersections within the county for deficient characteristics and provides recommendations for action if necessary. The intersection of CSAH 50 (202nd Street West) and Hamburg Avenue in Lakeville has seen significant development within the immediate surrounding area. This has led to crash patterns and frequencies exceeding statewide averages, which warranted an evaluation of intersection control changes to address these safety issues. The County completed an intersection evaluation in December 2023. The evaluation recommended to reconstruct the existing intersection into a single-lane roundabout. County staff coordinated internally and with the City of Lakeville to determine that a project was necessary to address these issues and increase safety. To pursue corrective action, the 2024 Transportation Capital Improvement Program Budget was amended by Resolution No. 24-071 (February 6, 2024) to add CP 50-37 to install a roundabout at the CSAH 50 and Hamburg Avenue intersection. Construction for CP 50-37 is planned to occur in the summer of 2025.

 

By Resolution No. 24-298 (June 4, 2024), the County Board authorized the execution of a contract with Stonebrooke Engineering Inc. for design services for CP 50-37. During the design phase, professional engineering services by Stonebrooke Engineering Inc. have identified right of way acquisition needs, including a permanent easement along the corridor (Attachment: Parcel Sketch). A single parcel has been identified from which right of way will be acquired by the County. Acquisition of right of way from the identified parcel is recommended to advance CP 50-37. Staff is proposing the acquisition of the necessary permanent easement from the identified parcel.

 

A minimum damage acquisition report was completed by Day Group LLC for the parcel. The total appraised value of the parcel is $5,200. Appraisal data has been provided to the County Board in a confidential spreadsheet since the appraisal is classified as confidential data pursuant to Minn. § Stat.13.44, subd. 3.

 

If timely acquisition by direct negotiation of the parcel does not appear possible, staff recommends that the County Board authorize the County Attorney’s Office to initiate quick-take condemnation of the parcel. Efforts will be made to negotiate an agreeable settlement before and after the start of the condemnation process.

EXPLANATION OF FISCAL/FTE IMPACTS

The 2024 Transportation Capital Improvement Program Adopted Budget includes a total of $500,000 for County Project 50-37. Sufficient funding exists for the right of way acquisition costs for CP 50-37.

WHEREAS, to provide a safe and efficient transportation system, Dakota County monitors intersections for safety or operational issues; and

 

WHEREAS, the intersection of County State Aid Highway (CSAH) 50 and Hamburg Avenue in Lakeville began exhibiting safety issues with crash trends that are above the statewide average; and

 

WHEREAS, County staff conducted a traffic analysis for the intersection, and the recommendation from the Intersection Control Evaluation is that a single-lane roundabout be implemented; and

 

WHEREAS, by Resolution No. 24-071 (February 6, 2024), the County Board authorized an amendment to the 2024 Transportation Capital Improvement Program Budget to include County Project (CP) 50-37 to construct a single-lane roundabout at the intersection of CSAH 50 and Hamburg Avenue in Lakeville; and

 

WHEREAS, by Resolution No. 24-298 (June 4, 2024), the County Board authorized the execution of a contract with Stonebrooke Engineering Inc. for design services for CP 50-37; and

 

WHEREAS, engineering design for CP 50-37 has identified right of way needs, including a permanent easement along the corridor; and

 

WHEREAS, right of way acquisition is needed in order for construction to begin in the summer of 2025 as scheduled; and

 

WHEREAS, to move forward with CP 50-37, the acquisition of the following parcel as identified in the legal description by the County is necessary to move forward with the Project:

 

Parcel 1; ANTHONY & BRIANNA LEMPELIUS; PID 22-13714-08-010

 

A permanent easement for highway purposes over, under, and across that part of Lot 1, Block 8, Berres Ridge 5th Addition, according to the recorded plat thereof, Dakota County, Minnesota, lying southeasterly of the following described line:

 

Beginning at a point on the east line of said Lot 1 25.00 feet northerly of the southeast corner of said Lot 1; thence southwesterly to a point on the south line of said Lot 1 30.00 feet westerly from said southeast corner and said line there terminating.

 

Said permanent easement area contains approximately 375 square feet.

; and

 

WHEREAS, a minimum damage acquisition report has been completed for the parcel by Day Group LLC and offers are being prepared for a total appraised value of $5,200; and

 

WHEREAS, values of the appraised parcel have been presented to the County Board in a confidential spreadsheet; and

 

WHEREAS, the 2024-2028 Transportation Capital Improvement Program Adopted Budget includes sufficient funding for right of way acquisition.

 

WHEREAS, in the event that timely acquisition by direct negotiation of the required parcel does not appear possible, it is necessary for the County Board to authorize the County Attorney’s Office to initiate quick-take condemnation of the parcel to allow for construction to be completed.

 

NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby approves the minimum damage acquisition value for the acquisition of the identified property interest from the parcel for County Project 50-37 and authorizes County staff, in its discretion, to share minimum damage acquisition data with the respective landowners, including all or portions of the completed parcel as part of the negotiation process; and

 

BE IT FURTHER RESOLVED, That the Dakota County Board of Commissioners approves acquisition of the property associated with the parcel for County Project 50-37 at the approved minimum damage acquisition value and authorizes payment from the 2024 Transportation Capital Improvement Program Adopted Budget; and

 

BE IT FURTHER RESOLVED, That the Dakota County Board of Commissioners authorizes the County Attorney’s Office to initiate quick-take condemnation of the parcel in the event that timely acquisition by direct negotiations of the property does not appear possible.
