RESOLUTION

WHEREAS, to promote a safe and efficient transportation system, Dakota County is proceeding with County Project (CP) 4-18, County Road (CR) 4 (Butler Avenue) Safe Routes to School Improvements, in the City of West St. Paul; and

 

WHEREAS, CP 4-18 was identified as part of the Dakota County School Travel Safety Assessment and will add trail and sidewalk along CR 4 (Butler Avenue) between CSAH 63 and Manomin Avenue to improve safety and accessibility for students and residents walking, biking, and rolling to nearby schools and destinations; and

 

WHEREAS, CP 4-18 was developed in tandem with CP 63-33, a planned reconstruction of County State Aid Highway (CSAH) 63 (Delaware Avenue) adjacent to the CP 4-18 project area; and

 

WHEREAS, CP 4-18 was awarded $320,000 in federal funds through the 2023 Regional Solicitation; and

 

WHEREAS, by Resolution No. 24-351 (July 9, 2024), the County Board authorized execution of Contract DCA21933 with Kimley-Horn and Associates, Inc., for professional design and right of way acquisition services for CP 63-33 and CP 4-18 in the amount of $1,832,900; and

 

WHEREAS, by Resolution No. 26-179 (April 21, 2026), the County Board authorized a first contract amendment with Kimley-Horn and Associates, Inc. in the amount of $217,070, for a new contract amount of $2,049,970; and

 

WHEREAS, additional tasks related to federal documentation for CP 4-18 are necessary for authorization of the federal award for CP 4-18 but not considered within the design contract; and

 

WHEREAS, County staff negotiated a fee of $86,995 with Kimley-Horn and Associates, Inc., to complete the federal documentation tasks and revision of plans to separate the project from CP 63-33; and

 

WHEREAS, the County Engineer recommends execution of a contract amendment with Kimley-Horn and Associates, Inc. in the amount of $86,995 for a new total contract amount not to exceed $2,136,965; and

 

WHEREAS, a budget amendment to the adopted 2026 Transportation Capital Improvement Program Budget is necessary to support the additional design and documentation work.

 

NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby authorizes the County Manager, or delegate, to execute a contract amendment with Kimley-Horn and Associates, Inc., for additional engineering consulting services for County Project 4-18 in the amount of $86,995, resulting in a total amended contract not to exceed $2,136,965, subject to approval by the County Attorney’s Office as to form; and

BE IT FURTHER RESOLVED, That the adopted 2026 Transportation Capital Improvement Program Budget is hereby amended as follows:

BACKGROUND

Dakota County is advancing CP 4-18 (Butler Avenue Safe Routes to School Improvements) to support a safe and efficient multimodal transportation system (Attachment: Project Map). The project also includes a mill and overlay of the roadway pavement and partial replacement of underground municipal utilities. Development of CP 4-18 has been in tandem with the adjacent CP 63-33, a reconstruction of CSAH 63 between Marie Avenue and Dodd Road.

 

The original work scope did not include tasks necessary for the authorization of the federal award, primarily environmental review and documentation. Additional development of a plan set and construction documents separate from CP 63-33 has also become necessary to allow for separate bidding and construction management so CP 63-33 is not encumbered by federal funding regulations. County staff provided direction on additional work to gain federal authorization for CP 4-18 and separate final design tasks and construction from CP 63-33. Kimley-Horn has submitted a proposed scope and budget (Attachment Amendment Request) for the following work:

 

•                     Project Management and Agency Coordination: $6,320

•                     Environmental Documentation: $10,250

•                     Production of additional plan set and bid $70,425

Staff recommends approval of an $86,995 amendment to the contract with Kimley-Horn and Associates, Inc. for a new contract total of $2,136,965, and an amendment of the adopted 2026 Transportation Capital Improvement Program Budget to add $86,995 to CP 4-18.

FINANCIAL AND STAFFING IMPACTS

The 2026 Transportation Capital Improvement Program Budget includes $352,565 for CP 4-18, all of which is committed to other project expenses. The requested action will require a budget amendment to the project to add $86,995 in revenue, including $73,946 in County Sales and Use Tax funds and a $13,049 city share.
