WHEREAS, the City of Rosemount desires to exchange the use of two fibers from Dakota County to connect the Rosemount Police Department at 14041 Biscayne Avenue, Rosemount to Western Service Center at 14955 Galaxie Avenue, Apple Valley; and
WHEREAS, Dakota County desires to exchange the use of two fibers from the City of Rosemount to connect the Criminal Justice Network at Rosemount Police Department at 14041 Biscayne Avenue Rosemount to Western Service Center at 14955 Galaxie Avenue, Apple Valley; and
WHEREAS, segment one owned by Rosemount consists of two dark strands of fiber from the Western Service Center to Rosemount Police Department; and
WHEREAS, segment two owned by Dakota County consists of dark strands of fiber from the Rosemount Police Department to a splice point at Biscayne Avenue and Birch Street; and
WHEREAS, a fiber optic indefeasible right to use agreement (IRU) by and between Dakota County and City of Rosemount is required for fiber optic use; and
WHEREAS, the City of Rosemount will be responsible for maintenance and relocation of any City-owned fiber facilities that are part of segment one and Dakota County will be responsible for maintenance and relocation of any County-owned fiber facilities that are part of segment two; and
WHEREAS, the city and county have agreed to not impose any fees or charges for use, maintenance, or repair cost associated with the IRU.
NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby authorizes the Deputy County Manager to execute an indefeasible right to use agreement by and between Dakota County and City of Rosemount, subject to approval by the County Attorney’s Office as to form.

BACKGROUND
Dakota County and the City of Rosemount maintain fiber optic resources. They have previously collaborated and continue to see mutual benefit in jointly cooperating on the use of existing fiber optic infrastructure.
RECOMMENDATION

Staff recommends the County Board authorize the Deputy County Manager to execute an indefeasible right to use agreement by and between Dakota County and the City of Rosemount.

FINANCIAL AND STAFFING IMPACTS
Dakota County and City of Rosemount have agreed to waive fees related to exchange of fiber strands.
