WHEREAS, the amended 2026 Capital Improvement Program Adopted Budget for the Burnhaven Library Renovation project is a total of $8,575,000; and
WHEREAS, by Resolution No. 26-132 (March 24, 2026), the County Board approved the original contract with Stahl Construction Company, in the sum of $3,778,000; and
WHEREAS, staff has executed one contract amendment totaling $249,350.26 to amend the work scope since work began in April; and
WHEREAS, this second amendment totaling $263,409.19, will make the total of all changes $512,759.45, which surpasses the County limit for total changes in any one project before needing County Board approval; and
WHEREAS, by Resolution No. 26-160 (April 7, 2026), Library staff received external funding in the amount of $175,000, via a Library Construction Grant for this reading garden amenity from the Minnesota Department of Education; and
WHEREAS, two-thirds of the construction cost for this reading garden amenity will be paid for from the Minnesota Department of Education Grant; and
WHEREAS, the remaining third of the construction cost for this reading garden will be paid for with sufficient uncommitted funds available within the project budget.
NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby authorizes the County Manager or delegate to execute a contract amendment with Stahl Construction Company, 861 Hennepin Avenue, Suite #200, Minneapolis, MN 55414, in an amount not to exceed $263,410, for a maximum contract total not to exceed $4,290,760 subject to approval by the County Attorney’s Office as to form.

BACKGROUND
The first amendment to the project added in large scope items as well as addressed the customary changes expected during a remodel of an existing building. The large scope increases include a complete renovation of the lobby public bathrooms which serve both the library and the License Center, new air handling equipment within areas not originally included, replacement of the penthouse ceilings with the addition of insulation, and sheetrock covering of existing spray foam insulation as required by the building official. These items will upgrade infrastructure throughout the entire building while taking advantage of its current closure to the public. The customary changes include unforeseen elements like replacement of the penthouse louvers, the addition of a unit heater at the penthouse, relocation of existing mechanical and electrical systems and other smaller issues. Like other exterior reading gardens incorporated into designs for Hastings, Kaposia, and Wentworth libraries in recent years, the reading garden construction within the second contract amendment to Stahl Construction will allow patrons direct access to an outdoor space for programmed events, reading, or meeting.

Staff recommends authorizing a second contract amendment with Stahl Construction Company to increase the value by $263,410 for the Burnhaven Library Renovation project. This will increase the total contract value to $4,290,760.

FINANCIAL AND STAFFING IMPACTS
The 2026 Facilities Capital Improvement Program Adopted Budget as amended for the Burnhaven Library project is $8,575,000 and is funded almost entirely from the recent sale of County debt. $175,000 of this budget was funded from a Minnesota Department of Education Library Construction Grant. There is sufficient project budget available to fund this second contract amendment with Stahl Construction Company.
