PURPOSE/ACTION REQUESTED
Authorize the Enterprise Finance and Information Services Director to amend the fiber optic Indefeasible Right to Use Agreement with City of South St. Paul.
SUMMARY
By Resolution No. 24-407 (August 13, 2024), the Board of Commissioners approved authorizing the Enterprise Finance and Information Services Director to execute an Indefeasible Right to Use (IRU) Agreement with the City of South St. Paul.
The IRU facilitates a jointly built network for efficient and secure public cyber traffic, under which the City of South St. Paul is granting Dakota County the right to own 144 strands in the City's fiber optic cable. The amended agreement clarifies that the fiber optic cable will be installed in conduit owned by Dakota County.
Staff is requesting that the prior authorization for the IRU Agreement be amended to include authorization for the City of South St. Paul to install and maintain fiber optic cable within Dakota County's conduit.

Staff recommends the Board authorize the Enterprise Finance and Information Services Director to amend an IRU Agreement with the City of South St. Paul for use of the jointly build institutional network.

EXPLANATION OF FISCAL/FTE IMPACTS
The City of South St. Paul will split the overall costs with Dakota County using existing Dakota County owned conduit and vaults. The total cost for each entity is $42,100.90.
