WHEREAS, the City of Rosemount desires to lease the use of two fibers from Dakota County to connect Rosemount Police Department at 14041 Biscayne Avenue, Rosemount to UMore Ball Park at 14860 Akron Avenue, Rosemount; and
WHEREAS, the of City of Rosemount will pay Dakota County for 1.95 miles of fiber at a rate of $65 per pair per mile for a total of $126.75 per month or $1,521 annually; and
WHEREAS, a fiber optic indefeasible right to use (IRU) agreement between Dakota County and the City of Rosemount is required for fiber optic use; and
WHEREAS, the initial term of this agreement is ten years, with two separate five-year renewals; and
WHEREAS, the effective date of the agreement is when all parties have signed the agreement; and
WHEREAS, Dakota County agrees to grant the City of Rosemount right to use two fibers within certain fiber optic cable segments on the terms and conditions set in the IRU.
NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby authorizes the Deputy County Manager to execute an indefeasible right to use agreement between Dakota County and the of City of Rosemount, subject to approval by the County Attorney’s Office as to form.

BACKGROUND
Dakota County and the City of Rosemount maintain fiber optic resources. They have previously collaborated and continue to see mutual benefit in jointly cooperating on the use of existing fiber optic infrastructure.
To support the installation and operation of security cameras at the Rosemount UMore Ball Park, the Rosemount Police Department requires a fiber connection between UMore Ball Park and the Rosemount Police Department.
