PURPOSE/ACTION REQUESTED
Authorize the Deputy County Manager to execute a Fiber Optic Indefeasible Right to Use Agreement (IRU) with Independent School District 196 (ISD 196) for use of unused fiber in the Dakota County owned institutional network backbone.
SUMMARY
Independent School District 196 desires to obtain the use of twelve fibers from Dakota County to connect to Emerald Trail Elementary and two fibers to provide redundancy, as described in the attached agreement. To facilitate fiber optic network expansion, and in accordance with our established practice of government entity collaboration, the unused fiber optic cables are available for this purpose.
The term of the IRU is ten years (2025 through 2035) with two optional five-year renewals that the parties will determine at that time.

Staff recommends the County Board authorize the Deputy County Manager to execute an IRU with ISD 196 for use of the Dakota County Institutional Network.

EXPLANATION OF FISCAL/FTE IMPACTS
ISD 196 agrees to pay the County $65 per pair/mile/month for use of twelve strands of fiber optic cable. This fee totals $104,452 over the ten-year agreement. Dakota County will be responsible for all costs of maintenance, locates, breaks, and fixes on the fiber.
