RESOLUTION

WHEREAS, by Resolution No. 23-202 (May 23, 2023), the Dakota County Board of Commissioners adopted Dakota County Ordinance 107 to provide for the safe and peaceful use of parklands and trails, for the education and recreation of the public, for the protection and preservation of the property, facilities, and natural resources, and for the safety and general welfare of the public; and

WHEREAS, staff recommends amendments to Ordinance 107 for clarification for enforcement and better alignment with State guidelines, Met Council taskforce recommendations, and the recently adopted 2050 Parks Vision Plan; and

WHEREAS, areas for revision include language and activity description updates, permitting hunting on conservation easements, and expanded regulations and improved enforcement strategies for electric-powered devices.

NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby schedules a public hearing for August 4, 2026, at 9:00 am in the Boardroom of the Dakota County Administration Center, 1590 Highway 55, Hastings, Minnesota, to receive comments on the proposed update to Park Ordinance 107; and

BE IT FURTHER RESOLVED, That the Dakota County Board of Commissioners directs staff to publish notice of this public hearing in the Dakota County Tribune and post it on the Dakota County website at www.dakotacountymn.gov.

BACKGROUND
The existing Ordinance was enacted in 2023, and over the past two and a half years, staff has identified areas within the Ordinance that require clarification to allow for proper enforcement and better alignment with State guidelines, Met Council taskforce recommendations, and the recently adopted 2050 Parks Vision Plan.
