WHEREAS, by Resolution No. 26-335 (August 4, 2026), the Dakota County Board of Commissioners concurred with the State Aid variance request for a reduced horizontal trail radius of thirty-eight feet along County State Aid Highway (CSAH) 9; and
WHEREAS, the Minnesota Department of Transportation (MnDOT) subsequently informed Dakota County that the variance request must also specify the proposed reduced minimum design speed of fourteen miles per hour and identify the horizontal curve station limits between Stations 58+09 and 58+64 in order to comply with Minnesota Rules, Part 8820.9995; and
WHEREAS, on August 19, 2026, MnDOT State Aid clarified that these additional technical elements must be included in an amended resolution before forwarding the variance package to the Variance Advisory Committee; and
WHEREAS, the amendment is technical in nature and does not alter the design, scope, cost, or prior concurrence actions previously approved by Resolution No. 26-335 (August 4, 2026).
NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby amends Resolution No. 26-335 (August 4, 2026) to specify that the reduced horizontal trail radius of thirty eight feet applies to the shared use path segment between Stations 58+09 and 58+64 and that the County proposes a reduced minimum design speed of fourteen miles per hour for this segment; and
BE IT FURTHER RESOLVED, That all other provisions of Resolution No. 26-335 remain in full force and effect; and
BE IT FURTHER RESOLVED, That the Dakota County Board of Commissioners directs Transportation Department staff to transmit this amended resolution to MnDOT State Aid for Local Transportation as part of the formal variance request package.
