RESOLUTION

WHEREAS, the County of Dakota (County) owns Parcel Identification Number 19-02900-30-010 (Property) in the City of Hastings (City), which is currently used for administration and judicial buildings as well as parking and open space purposes; and

WHEREAS, the County is planning to install a new fuel island located on the Property, behind the Judicial Center, and the project requires a new stormwater pond; and

WHEREAS, the City is the responsible party for managing the new stormwater pond, per the Stormwater Agreement between the County and the City; and

WHEREAS, the City has requested a permanent drainage and utility easement for access and maintenance of the new stormwater pond, encompassing 0.31-acres, legally described as follows:

A permanent drainage and utility easement over the south 85 feet of the north 213 feet of the west 160 feet of the east 510 feet of the Southeast Quarter of the Northwest Quarter of Section 29, Township 115 North, Range 17 West, Dakota County, Minnesota.

NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby grants and authorizes the Board Chair to execute the permanent drainage and utility easement legally described above to the City of Hastings for the access and maintenance of the stormwater pond, related to the new County fuel island, subject to approval by the County Attorney's Office as to form.

BACKGROUND
Historically, the County and its city partners have provided one another with necessary easements at no cost when the project served a public purpose. This continued cooperation helps achieve projects in a timely and cost-effective manner for the residents of the County.
