PURPOSE/ACTION REQUESTED

Authorize execution of an amended Cooperative Agreement with the Metropolitan Emergency Services Board (MESB) and the Minnesota Department of Transportation (MNDOT) for the operation of 800 MHz Radio System.

 

SUMMARY

By Resolution No. 04-213 (May 18, 2004), the County Board authorized the County to join the Metropolitan Regional 800 MHz Radio System and to request proposals for the design of the county subsystem. By Resolution No. 05-247 (May17, 2005), the County Board approved the submission of the Dakota County 800 MHz Radio Plan to the Metropolitan Radio Board (now the Metropolitan Emergency Services Board).  By Resolution No. 06-327 (August 22, 2006), the Dakota County Board of Commissioners approved the execution a Cooperative Agreement with the Metropolitan Emergency Services Board (MESB) and the Minnesota Department of Transportation (MNDOT) for the design, procurement, construction and operation of an 800 MHz County/Regional integrated subsystem.

 

Since 2006, the content of newer Cooperative Agreements has been updated as other counties have joined the statewide Allied Radio Matrix for Emergency Response (ARMER) system. The Cooperative Agreement is the formal agreement with the MESB and MNDOT that outlines the rights and obligations of Dakota County as a member of the regional public safety radio communications system in the metropolitan area.  Representatives from Risk Management, the County Attorney’s Office, PSC Alliance (the County’s radio consultant), MNDOT’s Office of Electronic Communications, and the MESB have been meeting to review and update the Cooperative Agreement. The Cooperative Agreement was updated to reflect current considerations of the regional network operation.  It remains basically the same agreement that has been signed by the other participating owners of regional integrated subsystems. The primary updates are the removal of terms related to the initial construction of the system and the addition of the cost sharing principles for the 10th site and 16th channel added to the Dakota County system that have been in practice since these additions were completed.

 

An attachment lists some of the key features of the Cooperative Agreement. Many of the features revolve around the cost allocation and operating rules of the regional radio network that is overseen by the MESB.  Dakota County has two representatives on the MESB.

Staff recommends that the Dakota Board of Commissioners authorize the County Manager to execute the amended Cooperative Agreement with the Metropolitan Emergency Services Board (MESB) and the Minnesota Department of Transportation (MNDOT) for the operation of 800 MHz Radio System.

EXPLANATION OF FISCAL/FTE IMPACTS

Funding for the support of the Dakota County 800 MHz subsystem has been incorporated into the 2023 budget. The operating costs of the Dakota County 800 MHz subsystem are shared across all the active radio users in Dakota County. The Capital Equipment Plan costs for the radio infrastructure have been funded from a combination of fund balance and homeland security grant funding as it has been available.

WHEREAS, the County, local and regional users of the 800 MHz radio system will mutually benefit from access and use of the system to provide interoperable public safety communications; and

 

WHEREAS, by Resolution No. 04-213 (May 18, 2004), the Dakota County Board of Commissioners authorized the County to join the Metropolitan Regional 800 MHz System; and

 

WHEREAS, by Resolution No. 05-247 (May 17, 2005), the Dakota County Board of Commissioners authorized that the County 800 MHz Radio Plan (Plan) be submitted to the Metropolitan Radio Board (succeeded by the Metropolitan Emergency Services Board); and

 

WHEREAS, by Resolution No. 06-327 (August 22, 2006), the Dakota County Board of Commissioners approved the execution a Cooperative Agreement with the Metropolitan Emergency Services Board (MESB) and the Minnesota Department of Transportation (MNDOT) for the design, procurement, construction and operation of an 800 MHz County/Regional integrated subsystem.

 

WHEREAS, the execution of a cooperative agreement with the Metropolitan Emergency Services Board (MESB) and the Minnesota Department of Transportation (MNDOT) is necessary for Dakota County to participate in the regional 800 MHz system.

 

NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby authorizes the County Manager to execute a Cooperative Agreement with the Metropolitan Emergency Services Board (MESB) and the Minnesota Department of Transportation (MNDOT) for the purpose of defining the rights and obligations of each party with respect to the design, procurement, construction, ownership, operations, funding, and maintenance of a County/Regional Integrated Subsystem, subject to approval by the County Attorney's Office as to form and substantially as presented in the attached agreement.
